Premier Park - Brixham

Hi all

A KEEPER has been served a PCN by Premier Park, in reference to using a car park in Brixham, Devon, while on holiday.

The letter shows the VEHICLE entering and leaving. THEY paid for 5 hours, but the time from entering, to leaving is 5 hours 23mins. In that regard, ON PAPER it could be suggested that the driver overstayed.

However, while that is the case, it took a good 10/15 mins for the driver to find a space, plus getting the kids out of the car, then maybe another 5/10 mins queuing for a ticket. It was a small tight busy car park, that was extremely busy with people queuing for a ticket

So while the VEHICLE was in the grounds of the car park for over 5 hours, the VEHICLE might have been within 5 hours according to the purchased ticket. Of course the driver has binned it now, and no way of knowing.

Can he/she contest this?

Thanks in advance

edit the above to remove any hint of who was driving

    use

    THE DRIVER

    THE KEEPER

and any pictures do not show a person, they show a VEHICLE entering and leaving

and you have NOT received (been served) a pcn , the KEEPER received it

and GRACE PERIODS may cover the overstay that you mentioned , so read the relevant CoP on these issues

and read the NEWBIES sticky thread and follow the advice in there

appealing as KEEPER , nothing more

OF COURSE it can be contested, if the correct wording is used

it was still incorrect so I have modified it for you , please duplicate the above back into post #1

CoP is shorthand for Code Of Practice (there are 2 , 1 for each trade body)

this court case in Newquay by ivor pecheque is similar

    http://parking-prankster.blogspot.co.uk/2014/03/waiting-for-space-is-not-parking.html

grace periods also cover EXITING the busy car park as well , so 2 grace periods , not one

now read these similar threads with the suggested appeal wording (if the PREMIER PARK you refer to is the one in the BPA AOS scheme) ?
