Parking Eye PCN: 10 minutes over

Hi,

I just got a PCN from parking eye with an amount due of £60 (if paid within 14 days, rising to £100).

It was in a Halfords/Range car park and the PCN states that the time in car park was 2hrs 10minutes, which is 10 minuted over the stated maximum of 2 hours. The actual times show that it was 2hours 10 minutes and 49 seconds.

I am minded to pay this charge as I don't really want to go through months of hassle and nasty letters, but wondered about a couple of things:

1. If I appealed the charge, would I have to pay the full £100 if I lost the appeal as I would be over the 14 days period, or does this get frozen?

2. Is there not some kind of grace period, or is this only upon arrival?

Any advice would be appreciated.

    It is unlikely that you would lose in court, although PoPLA might find for their mate. But a PoPLA loss is not binding on you.


    Read the BPA Code of Practice re grace periods.
    You never know how far you can go until you go too far.

    you have every chance of winning this simply on grace periods, never mind anything else (PE monitor TIME ON SITE , not parking time)

    you have maybe UP TO 21 minutes GRACE PERIODS

    read the BPA CoP clause #13

    and use this blue text appeal to appeal it on their website , as KEEPER (not as driver, never even hint at who the driver may have been)

    The 14 days discount is "set in stone". So if you appeal the "discount" is gone.

    But it isn't really a discount, its a bribe to make you pay up and shut up without a fuss and any effort on the ppc's part in extracting cash for their already swollen coffers!

    Hope you have changed your mind? They are trying it on. They will also reject the appeal but you'll win at POPLA, on the two grace periods point. No hassle.

    There is a slight niggling issue that I'd like to raise with my case.

    It looks as though we hadn't updated the V5 after moving, so the PCN originally went to our old address according to ParkingEye. PE explained this in a covering letter, (dated 9th August) which came with the PCN (dated 17th June) to out current address. The letter states that they had used a CRA to find us.

    My question is, will this have any bearing on our appeal?

    Another question: Why doesn't the initial appeal text (blue text referred to in post #3 of the newbies thread) not also mention the charge as being unreasonable for a 10 minute overstay, or is that irrelevant?

    The blue text appeal is simply designed to get everyone using it a popla code.


    You are fortunate they traced you - presumably the original correspondence was returned to sender.


    Had they not traced you then you could have ended up with a ccj on the record for 6 years blighting your credit without you knowing!
