    There are a fair number of employers that completely ban the use of phones/taking photographs

    But I suspect you mean during working hours / on employer premises. Which is what I'm asking.

    Quite. Plus not bringing your employer into disrepute is an implied duty for any employee regardless of whether it is specifically spelt out.

    As I said before, when this thread was current, the son's behaviour (even just the part he admitted) would be more than enough to warrant dismissal from many employers. So a final written warning is the best he could possibly hope for.

    Should be real fun working there now!

    Well, I don't know. but it was well established that they had no idea he had posted anything on social media, so that's not something you can assume. They had accused him of making obscene gestures at a baby.

    They hadn't accused him of the part that was admitted to in the thread. They had no idea about him sending that photo or even taking that photo as nobody except the friend he sent it to ever saw it. It was NOT posted on social media. It took a long while, but the OP eventually clarified this.
