But can you confirm where you get the line that esa is not "automatically" reinstated when someone carries on from the MR to the appeal

This is what I mean, isn't that a different question?

To answer this question, not everyone on ESA appeal is entitled to be reinstated onto ESA pending appeal.

FTRQ appeal and FTA WCA appeals are not paid on appeal

No LCW appeals are only payable now if the claimant was in the SG or WRAG immediately prior to the No LCW decison being made. OR if the claimant's most recent WCA decision was not "No LCW".

    Yes I understand that.

I think what I'm trying to establish is when ESA is "automatically" reinstated on appeal. Like Alice my concern is about those who haven't claimed JSA during the MR period (I find a number of claimants don't).

This is a summing up of what I thought was the general position

https://dpac.uk.net/2014/03/some-info-on-mandatory-reconsideration-routes-for-esa/ (CPAG say much the same)

Can you confirm from your understanding whether this is so please

Sorry if I was confusing earlier. My original thoughts were a bit muddled and I didn't express myself well

I did not read your link, I will read tonight,

But ... Assuming a claimant would be entitled to payment of ESA on appeal and they have not claimed JSA or IS
    A) they would need to continue to supply Med3 from the date the previous one expired.
    B) Whatever guidance says on the subject.... It is my experience that without customer intervention and a HOTT being sent, you are looking at about 8 weeks (from the date the appeal is received by DWP) before it would be done and it may never be done without intervention.. With customer intervention you are looking at within 2 weeks & possibly 3 - 4 days..
  • I would like to thank you all once more
Done as you said phoned closed jsa called bk to make sure it was closed then phoned esa and hopefully touch wood it'll be up and running by 23/08

Asked about my back pay they just said my esa claim was originally started in Feb 2016 and should get back pay from 14 weeks after that
To be honest I don't know how much difference there is or anything
So I guess I just have to wait and see
But not had any further letters only the one telling me my mandatory consideration was overturned n into support group on the 10th of August

It's like a bloody waiting game

But thanks all I appreciate everyone of your comments x

Support Group pays a premium of roughly £30 per week over the assessment rate. I'll leave you to do the calculation, but it's quite a few quid coming your way.
  • Thank you Tellit
Just glad it's all over to be honest can finally stop being on edge constantly x
