Hi
Just wondered if anyone can help me. Me and my partner went on our honeymoon recently and had a delay, we was told it wasn't going out that day and we wasn't classed as a priority. We decided to purchase another flight at a cost to our self.
I put a complaint in and someone contact me Saturday saying they are giving us 1200eurros as compensation. Everything was agreed and I was told it was to go into my account in the next 10 days.
Around an hour later they emailed me and said due to change in the law, as we purchased another flight we wasn't entitled to it any more and just refunded us the original flight cost (£407!).
My argument is I told them we purchased another flight in the original complaint and the amount was agreed (verbal contract) do I have any right to pro-sue this or am I just wasting my own time and energy?
So angry feel like were being discriminated against for being in a position to be able to purchase new flights. It actually ended up costing us over £1,000. I have tried doing some googling and not really found anything.
Any information or advise would be great.
Kind Regards
Michelle

There is a board entitled:
Probably best to get this thread moved there.0 -
I can't see that you are due a refund of anything more than the cost of the flights. Had you not purchased alternative flights yourself then you would have been able to require the airline to reroute you to get you to your destination as soon after the original arrival time as possible, which might well have been on the flights you did purchase.0
-
They wouldn't reroute us a we wasn't classed as a priorities, so it was a case of just waiting for 24hours they wouldn't let us check in so we was literally just sat on the floor. I asked about purchasing a different flight and they said if we did it online they would just take it off us any ways and give them to someone else. We had to purchase flights to the other side of America.
I just don't understand why everyone will receive full compensation except us especially when we took a loss of money to get where we needed to go. Can they offer you so much then change it?
Thanks for getting back to me0 -
Generally speaking no, they cannot offer you something you accept it then they decide to change it, however was this done via email? If not you may have difficulty proving it.0

I don't understand it either, which is probably why I don't post on The Flight Delay Compensation Board.m_haines86 wrote: »I just don't understand why everyone will receive full compensation except us especially when we took a loss of money to get where we needed to go.
Yes they can, until such time as you accept their offer.m_haines86 wrote: »Can they offer you so much then change it?0 -

I'm thinking more that its not covered by the EU flight delay rules but it wouldn't stop the OP claiming breach of contract & having damages awarded on that basis. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

Just to clarify, there are only certain criteria for which you can claim discrimination and this is not one of these.
This is the second thread on getting compensation?0 -
You should post this on the relevant Airlines thread on the Flight Delay Compensation Thread. That is for dedicated questions like yours. Also google download and read Vaubans guide that will help.0

I'm just curious...
why haven't you posted your query on the Flight Delays board?
That seems to have been the most prominent 'help' you have received.0
