It is entirely legal to dismiss someone who's on long term sickness, as explained here - 5 months off and no sign of returning is not an acceptable recovery period.0 -

I never said it was not legal. I was trying to add something to the thread.
Anyway, my doctor said I was not fit to return, the DWP doctor said I was not fit to return and they still done what they done. I have no tissues and issues with that though, so thanks for the hyperlink but NO THANKS.0 -

I went off sick because I was assaulted outside my office whilst waiting at the bus stop to go home. Assaulted by someone who had beef with the Jobcentre Plus.
Just because I was 10 feet away from my place of work, inside the bus shelter, to me equals it was a work related incident.
I never said I was surprised I got the sack.
Finally, why someone has pressed THANKS to your comment to me is terrible.0 -

It could be contentious as to whether the incident with the attacked person in the bus stop was not 'work related' aggression.
Would the attacked person actually be at the bus stop if he was not working at the DWP where he was based? Unlikely.
Furthermore, the attack was allegedly related to the perpetrator having a gripe with the DWP who was the attacked persons employer.
The dismissal is of course another issue and his employer can potentially get rid of an employee under such circumstances.
Ironically, the injured person would likely have to claim any entitlements from the very department from which he worked.Jonmenzies wrote: »Finally, why someone has pressed THANKS to your comment to me is terrible.

That's terrible, I hope your partner feels better soon.
It sounds very unprofessional of the company. Using someone with no training and putting them at risk probably just to save money. I'd say they have failed to protect your partners health and safety. I'm no expert so I think I might be tempted to seek some legal advice. He was in a sticky situation, probably feeling unable to turn down the stores request that he do security but was a risk for doing so.0 -
