  • ok i know I am late coming to this one but I am new to mse and saw this thread
    it makes me so so mad angry-smiley-030.gif that people like this take something like bankruptcy and make it into something that it really isnt

    most of us here who ahve ever gone bankrupt have NOT done so lightly we have struggled and struggled not knowing what to do and then as a last resort go b/r

    well JoeHel I REALLY hope this guy gets whats coming to him, i dont know if law allows but i think the guy should have to pay your OH back by making him sell his house - he can always rent
    OR put him behind bars
    he has commited serious fraud, AND even before going BR obviously commited some pretty serious H&S offenses at the workplace for the accident to even happen

    on a side note I would recommend possibly calling ACAS - google it but do NOT click on the sponsered lnik its a different company who will want to get all the details from you tell you to call acas anyway THEN call him offering HIM help CHEEK!

    I REALLY hope things work out for you , you deserve a break

    Thank you very much for your kind words. As I've said before, I TRULY sympathise with anyone forced to take the bankruptcy route because I am sure it is heartbreaking. But this guy is a SNAKE. He's playing it like a fiddle. He even asked the OR how he could put his assets in other people's names to say they are not his!!!!! She is on a mission to nail him and I'm trying to help in any way I can. My deepest desire is to have paid off all our debts by the time my OH gets his money (with lots of lovely interest) so we can put that money down on a house and build our future on it. I feel very sorry for his family to be saddled with such an arrogant and stupid husband/father but what goes around comes around and this guy deserves bucket loads of bad luck. I'm a genuinely nice person and I've never wished ill of anyone so this is a first!!!

    Garnishee Order

    You can use a garnishee order to force a third party who either holds money belonging to the debtor or owes the debtor money. The garnishee order only works once at the moment it is served. If there is no money in a bank account at the time it is served then the order fails.
    To apply for a garnishee order you need to fill in a copy of Form N349 and send it to the court with the appropriate fee.

    From what he's telling the OR, he has nothing in his bank account. Part of the bankruptcy is an £8k overdraft. But the OR has requested direct from the bank the statements that he's refusing to supply. They may show what he is hiding!!
