have you researched the ex-boss? use companies house to see if its a ltd company, you have payslips, and therefore tax references, have HMRC had tax returns, you can enquire about your guys N.I. and tax contributions, if its a ltd company has it submitted accounts? is he listed as dormant but trading, who are the directors? can you credit check the boss personally, where does he live, check "my house prices" or the land registry....

Thanks for the update, JH. I'm pleased to see that the OR also feels the same way as you. If he had liability at the time, perhaps a retrospective claim can be submitted - I know that I had to keep all of my Insurance details for many years, in case of any retrospective claims.
Hopefully, now, there will be some light at the end of the tunnel.
Good luck, and keep us posted.

Thanks rog2. You have been a star with all your fabulous advice too.

The OR and solicitor mentioned the insurance yesterday, but both said that an insurance company is unlikely to accept any liability whatsoever because he never made a claim or told them the details. If he had passed the matter to them immediately, they no doubt would have set their legal team to work and could quite possibly have negotiated a much smaller award. It is likely that an injury of that nature would have been settled for about £5k (which Joe would have been very happy with!) Because it was left so long, and so many additional charges have now been incurred - i.e. the £26k solicitors fees - they think it very unlikely that the insurers would accept a claim at all.

I'll report back again when I hear again from either the solicitor or the OR. They are both now so determined to get the truth from this lying scumbag!!!

Apparently he visibly paled when he discovered the personal injury award wouldn't be included in the bankruptcy no matter what.

    ....

I dont suppose the OR video taped the interview? thats one i would love to see on youtube:p

Glad to hear there seems to be evidence of wrong doing, and although it doesnt win the batle for you, yet, it should more than help
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

That is what the OR is doing at the moment. She said it's like trying to walk through mud with the level of (un)co-operation he's giving but she's getting there. I do have access to various things so I can have a trawl myself which I think I might do, just to see if I can find out what he's been up to this year.... ;)

Sounds like a really nice guy:rolleyes: Personaly i wouldnt have started the interview untill he did, and made him sit there all day if i had too:p But the OR is too busy to play games i suppose.

At least you know he is not going to get an easy ride through BR and will hopefully shoot himself right in the foot and end up in court for contempt on top of everything else:D

Yeah, he's an absolute charmer, this one....

Right, I have got the report from the Insolvency Register and I can see his current address and his trading name, but when I search on Companies House there is no company either existing or dissolved with that name. So he obviously didn't officially register it. A BT search is showing nothing in his name at the address listed on the insolvency register. So he must be ex-directory. I guess that is a dead-end as far as finding out what he's up to business-wise, short of hiring a detective to follow him for a week!!!

you must know what line hes in? also google his landline and/or mobile and/or email addy, it throws up some interesting stuff!

also google his home post code, his name, and (if you can) credit check him

"info-uk" can do household/neighbour searches for home and/or business addresses (if you have it or pay)

check "my house price" to see if his home has changed hands too

    Another sort-of question...

If someone who is bankrupt is working, is there usually some sort of payment plan whereby you pay your creditors SOMETHING each month?

I've done some investigation on this guy and it looks to me like his home has now been converted into a business - all in his wife's name of course - but from various little snippits I've found on the internet there is definitely a business going on there (and one large item been sold).

If he is not working and all the family income is coming from this business, does that mean that the creditors get nothing at all?

He went bankrupt last July and we haven't seen a penny since. I understand that his family still have to live, but is it right that absolutely NONE of the money from this business can be used to pay to creditors, if it's in his wife's name?

Hi ya .. yes there is, its called an IPA whereby if you have over £99 surplus after all reasonable living expenses have been taken in account then you pay a percentage of your surplus ranging from 50-70%

e.g. I had £360 surplus and pay £238 a month for three years.
    :hello:
Save a little money each month and at the end of the year you’ll be surprised at how little you have.
An eye for an eye only ends up making the whole world blind
