    ahh, thanks.

    But if the business is all in his wife's name, and he (on paper) has no income whatsoever, do they take his wife's income into consideration?

  • Not really no JoeHel sorry A BR,s partner is only expected to contribute there share to the houshold expenditure, so if on his I&E it shows she is paying 50% the OR has no powers to investigate further .

    Although if fraud is suspected they may be able to apply to the courts for the power to investigate further, but they would need very good reason for a judge to allow it

    Thank you. I think the OR is already heading down the fraud route.

    It's just all so frustrating. Feeling really down about it today. We still have so much to pay off and my OH is likely to be in a wheelchair within 10 years (because of this accident at work) so we're running out of time to get rid of our debt before we lose his income. And this pig of a man can swan around and get out of paying the £21k he owes us. I mean no offence to anyone but I seriously think bankruptcy is a complete f****ing joke at the moment!! :mad:

    No offence taken and your fellings are more than justified, I know its easier said than done but as it sound like the OR is on the case and on your side all you can do is sit and hope she finds anything that may help get you get your cash, but in the meantime it wont hurt to pass on what you have found out;)

    I can understand your feelings we are going through a similar thing with a guy next to my parents who's gone BR owed god knows how much (including cash from my elderly mum & dad i recently found out) and he's swaning around without a care in the world..BUT the OR is on the case and the wheels all be it slow are starting to move so hopefully eventually you get the answers you need

    I've tried calling the OR this morning but no answer. I'll try again later. I'm sure she must know about this business, but doesn't harm to make sure, eh.

    I've even got a copy of the notice where the planning permission was REFUSED for this business, but from the adverts they are placing it looks like they've gone ahead anyway.... Mind you, getting the business closed down is hardly going to get our money back is it!
