Getting a Default removed.

Hi guys,

A few years back I got myself into a right pickle and got myself into debt.

I got a loan to consolidate from Sainsbury's to try and sort things out, but things didn't go to plan i ended up defaulting the loan.

The default date was in August 2013.

Recently i received a letter from Sainburys saying they charged me £25 by mistake on May 13 ( 3 months before me default date) and gave me £32 refund.

Now, my argument here is, could I now dispute the default and saying that this wrong charge made me default? I paid back the rest of the loan a few months later I just didn't have it at the time.

If I do have a case could someone give me some advice on how to go about it?

Thankfully now I'm in a much better job and much more financially secure, but I still feel this one thing is holding me back dearly.

    I doubt that you defaulted for £25.
  • No, of course it was more, but they added this on to my bill witch then I was unable to pay simply not having enough funds.

    I'm really desperate to get this default removed and want to try and somehow appeal it saying that there mistake led to the defeat, any advice greatly appreciated.

    It's not an argument that will fly, simply because it's not true. Don't make a fraudulent accusation.

    Fraud markers are much worse than defaults.

    I also doubt you defaulted for £25... If you answer these Qs I'm sure you'll get a better picture.

    1. How much where your monthly repayments?
    2. How many payments had you missed before being Defaulted?
    3. What was your arrears when the account was Defaulted?
    4. What was the balance on the loan when Defaulted?
    5. After the Default, how long did it take to pay off the balance?

  • I tried to upload a picture from my credit file but it wouldn't let me, that is a copy and paste job.

    My monthly repayments were £65
    My first missed payment was March, I defaulted in August.
    My balance was 389 in February then 414 441 469 473 428 until august it was at 430
    My default balance was £430
    A payment plan was set up in October and I paid it back without a hitch until April 14.

    So, you think there is no argument for me to say I feel that this added to my financial worries and I think contributed to me going default.

    You defaulted for £430.

    The fee in question was £25.

    It took you 13 months from your first missed payment to settle the balance.

    I don't think the £25 was a defining factor.

    No OP sorry you will not have a chance unfortunately. The charge on the account wouldn't of incur 'more charges' to the account it was a single charge. So you wasn't at any detriment for having a charge added. You still owed a balance on the loan and was behind on your payments unfortunately.

    From what you mentioned if I've read it right, so you stopped paying in March, then 5 months passed before the account was defaulted in August. You only then agreed a repayment plan in October (8 months later) since you last paid in February? C'mon the £25 wasn't a factor at all.

    Thanks, i know i'm clutching at straws a bit, just thought it was worth looking into, just with the charge coming before my default date.

    I just find it very frustating that I could easly pay it back today, but if anything the whole thing has made me much more financially savy , every cloud eh :)
