Bristow & Sutor - Implied right of access

Hi everyone,

I hope this is the correct forum for this?

We have some outstanding debt that has been transferred to a company called Bristow & Sutor.

In an attempt to get them off our back for a little while, I wrote to them removing their Implied Right of Access.A few days later I then received a reply telling me that they would ignore it and if they incurred fines due to suing for trespass, they wouldn't pay the fines.

Any ideas/help on how I reply to this? They have trespassed around four times since I received that letter.

    Im almost certain they would be open to a payment plan ..
    metaphorically sticking your fingers in your ears doesnt make the problem go away !!

    Your link doesn't work.

    The court has given them the right to approach your property. They are not trespassing. They will stop visiting you if you start communicating and make a reasonable payment arrangement.

    Please keep in mind that your debt will increase each time they visit. It is in your interests to start managing your debt.

    Given that you make no mention of the amount owed, your financial circumstances or the contents of the letter you sent them I'm struggling to see what other advice could be provided.

    Knowing what you sent them would be a start.

    OP, you really need to treat this council tax debt seriously.

    You were given good advice last year, but appear not to have heeded it.

    That DEFINITELY isnt going away, and as posted above, each visit will add another £100 at least onto the bill - which you will HAVE to pay eventually.


    You are lucky you are being offered installments TBH , they dont play games where council tax debts are concerned - Hurry up and get something in place before they come with a removal truck !

    Enforcement Agents get 'right of access' style letters everyday, it very rarely has any practical effect due to the fact they are working within legislative powers. The letter from them is actually quite polite - it doesn't point out the council's power of committal as most do.

    It would appear that nearly a year later the Local Authority are still chasing monies . There will be no extra payments each time they visit as the charges are restricted in law at £75 for the initial letter and another £235 where they attend with the intention to remove goods.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
