Vigin Media giving me a bad credit score can I sue them?

I cancelled my Virgin media broadband 6 months ago. I paid one month in advance and gave one month notice of leaving. I, therefore, could not have owed them money. They disagreed for weeks and sent the case to a debt collector. I then spoke to a Virgin call centre girl who said she could not send me a statement as it was with a debt agency. She then noticed in her records that there was a 'false contract termination fee' of £25.00 which she then deleted and said she'd take it off the debt. I am still getting a monthly comment on my credit score stating I am behind on this payment. I'm still attempting to get them to cancel it. What I'd like to know is if I can sue them for reducing my credit score incorrectly and if so who do I approach?

It's not the score which is the issue. It's whether it is being reported as in arrears.

When you say you cancelled your contract, were you still in your contract period or was it outside of this?
Why would/did you pay 1 month in advance?
Did you not receive a final bill?
I'm guessing you thought that by giving them 1 month's notice that they would use your 1 month's advance payment to cover that final month? If that is your line of thought then you are in the wrong and that's what has caused all this.

Ive got issues with Virgin and they charge a month in adavance,so in theory if you give notice at month 11 of the 12 month contract you should be fine.
However Virgin are great at making it complicated,esp if you have loyalty discounts.
Snap shot i used to pay £40.10..final bill by agreement was £20..billed £20..payed £20 computer says bill is £83.10 (figure that) and get late payment marker dispite fully paying and Virgin state they cannot and will not remove the marker on CRA despite it being incorrect.0 -

So, you can get any incorrect data removed from your credit file, but at the moment, whilst the dispute remains unresolved, they are arguing this data to be correct, hence they will not remove it. I appreciate this is the whole point of your dispute.
I would ask for a breakdown of the debt, plus a copy of phone transcripts to try and support your complaint going forward. You can ask for things like this under a Subject Access Request, which can cost £10 to do and they have 40days to comply. If you are unhappy with Virgin media's final response you will need to take it to the CISAS, who regulate them.
In terms of taking your own legal action, I am afraid this is not something I am aware of (although you can discuss it with a legal advisor -just be careful of fees). It would be more common to request compensation through the complaint if the incorrect data has caused you problems.
