Hi folks.
Recently been ticketed by Excel after parking my motorcycle in Newcastle under Lyme. Was told to park there by a police officer due to a string of thefts in the area. Was not obstructing anything at all. Anyway, I returned back to my bike to nothing, and thought nothing of it until two weeks later the notice came through the post. However viewing their photographs theirs shows a pcn notice attached to my bike whereas it wasn't there when I can e back to it, or is it in the photographs I took of the bike when I returned to it. I appealed on this basis, but it got rejected, citing they were happy it was correctly issued. Should I just stump up the £60? They say I can appeal to the IAS, but from what I read that's a garunteed loss.

You have been scammed by scammers. This is called ghost ticketing and seems to happen far to often, but unless you catch someone in the act of ticketing, photographing, and removing the ticket, there is nothing you can do about it.
Of course you shouldn't pay. Unfortunately you have made a few schoolboy errors by giving away the driver's identity, unless you appealed as keeper, and appealed using mitigating circumstances instead of legal points.
There is nothing you can do now except ignore anything and everything you get for the next six years, except real court papers.
I don't suppose you took the name or number of the police officer did you? You could go to the local police station and see if you can get anything in writing about the parking policy you followed.

No, I don't believe it is. It is the advice from the NEWBIES thread written by a very well respected forum member who has far more experience than I do on this subject.

So they are alleging it was a 'windscreen' ticket but you received a notice in the post just two weeks after the parking event, is that correct?0 -

I guess it's naivety on my part completely to listen and do as police have told me when it comes to this situation. What is the likelihood that ignoring will lead to a court appearance or other troubles? I have heard of other people never hearing anything from them, but knowing my luck I would be the one that they would pick!

1) at the moment excel are taking lots of people to court, but the BMPA zendesk is a good source of info too

or is it because they are naive and think its "gone away" after 2 or 3 years ?
EXCEL and B W LEGAL have issued both LBC and MCOL court papers AFTER SAY 5.5 YEARS , seeing as they have 6 YEARS to do so
I think this is pure conjecture from tap room "lawyers" , who dont understand that not hearing anything for several months means it has "gone away" - it hasnt
but who knows ??, they might not ask BW LEGAL or their own in-house team to pursue it through legal channels , so come back and tell us in 2023
