Apprentice due to go on sick leave after an op soon, sick note question?

Hi All

Just looking for a spot of advice really. I am a nursery apprentice who makes 3.50 an hour. I am on a 30 hour contract. I am due to go in for an operation on my ear next month but unfortunately will be off for two weeks to recover. My boss has said basically I have a load of leave stacked up so I can take the two weeks off as paid annual leave. Or I can take some time off before my op paid but I wouldn't be entitled to sick leave.. I have Aspergers and Dyspraxia and this is my first long term job, so pretty new at this so my question is this... do I still need to send my note to my boss or do I send it to the job centre? many thanks in advance.:o

    Even though you said you wouldn't be paid sick pay, you would still send it to your place of work, not the job centre.

    You can take sick leave. Whether you are entitled to be paid is another matter. Based on your income it's likely too low for SSP.

    If you take the full period as annual leave you won't need to provide a fit note. If you take it as sick leave and are off sick for more than 7 days in a row (including non-working days) you'll need to provide your employer with a fit note.

    On such low earnings you probably won't qualify for Statutory Sick Pay (SSP) so your employer may be suggesting using holiday so that you still have income.

    Off-topic perhaps, but that's the lowest rate of pay that I've every heard of ; I hope it gets better.

    If OP is over 19 it will increase after the first year.

    That's the hourly pay of an apprentice.

    Unfortunately Geoff, apprentices legally get paid very low amounts. My under eighteen aged counterpart, gets paid about £2.70 -_-. If our boss decides to renew our contract only then will we be entitled to full minimum wage. I have been on my apprenticeship for nearly a year now. Trouble is, my contract expires September 1st, and I started the apprenticeship on the 15th September last year :/ My assessor has been a tad slow in sending the work I need to do. So hopefully they won't get rid of me early, otherwise the apprenticeship provider could charge me £800 for not finishing :(

    Why is you le colleague accepting less than NMW (for apprentices)?

    If you contract is due to end in September and you've two weeks leave to take, I'd do as your boss suggested and take the two weeks annual leave and not submit your sick note. By not taking it you're working for even less than your wage.

    She was told thats what she is entitled to for her under eighteen age group :/
