  • I am now at the response to the Operator's "evidence" stage and have what appears to be a technical problem. I have drafted a response, but whenever I try to paste the text into the response box, it restricts the characters. It's about 850 words long and other replies I've seen look longer. Am I doing something wrong ? Is it possible to upload a PDF as I can't see how ?

    Convert to .pdf file and attach it to an email. Make sure your covering email has all your POPLA and PCN reference numbers (as well as your rebuttal having them). Ask that POPLA confirm receipt of your rebuttal and confirm that the assessor will read it before final assessment is made.

    Give POPLA a phone call as well the say after you email it to double check its receipt.

  • Any idea how long POPLA take to deal with an appeal please ? I submitted my response as keeper to the Operator's evidence on 12th October and received an acknowledgement straightaway but have heard nothing since. The website says it is still in progress. To me as they have breached POFA it is straightforward to deal with but I'm keen for it to be finalised now and have also read the stuff about Indigo no longer issuing codes for rail parking...

    Usually about six to eight weeks, but who knows as they obviously want to sweep these ones behind the back of the sofa!

  • Right, it now over 6 months since the original ticket was issued and the POPLA site is still saying "We have received your comments and we will begin your assessment in due course". Does this now mean that nothing further can happen ? Do I need to do anything else or just forget it ?

    Thanks, I thought that after 6 months had elapsed even the TOC can't take any action so chasing POPLA for an update seemed a bit pointless as everything has timed out anyway ? I don't really get this 6 months thing if they can just sit on railway appeals indefinitely.

    It’s 6 months for a criminal prosecution in the Mags Court - and only via the TOC.

    It’s 6 years for an alleged debt (a civil case) in the County Court - via Indigo.

    This is the confusion that abounds, Indigo trying to impose a byelaws penalty, but have no means of enforcing it, but trying to have their cake and eating it by the sowing the seed of doubt in minds that they might go for a CC claim in the next 6 years.
