There was a case identical to yours where the driver said they'd entered the full reg (why on earth would one only enter the first digit?) and it must have been machine failure. The judge agreed and dismissed the case. Try searching on Parking Prankster's blog for it.
Of course credit must be given against the charge for the money already paid. POFA specifically says this in respect of claims against an RK, and in respect of the driver on the principles of contract law they'd have to give credit for what's been paid against the damages being sought.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. in an ideal world , the ANPR (camera) would have taken the VRN of the vehicle , and simply refused to issue a ticket because a vehicle with the VRN of "a" had never entered the car park0
