  • There was a case identical to yours where the driver said they'd entered the full reg (why on earth would one only enter the first digit?) and it must have been machine failure. The judge agreed and dismissed the case. Try searching on Parking Prankster's blog for it.

Of course credit must be given against the charge for the money already paid. POFA specifically says this in respect of claims against an RK, and in respect of the driver on the principles of contract law they'd have to give credit for what's been paid against the damages being sought.

Thank you all for your help with this. I will come back should I get the LBCCC or real court papers from the CCBC.
I'll keep you posted. Although my wife is worried I can be stubborn when I think there is an injustice.

    Good morning all,

From your experience, if I don't pay and it goes to court and I lose, what sort of costs am I facing please?

    Thanks

A better question would be what are the odds of me going to court?

Take a look at how unlikely this is currently. http://www.bmpa.eu/companydata/Britannia_Parking_Group.html

in an ideal world , the ANPR (camera) would have taken the VRN of the vehicle , and simply refused to issue a ticket because a vehicle with the VRN of "a" had never entered the car park
And to cover the situation of mistyping, the ticket-issuing machine could display the Make and Colour of that reg, as held on the DVLA website. Of course, the parking company isn't interested in that. Next they'll be wanting the 16 digit VIN.
