    As posted you'll need to reply on your legal advice here. Clearly there is an issue with this particular restriction which the repossession does not override

    Anything is possible with old deeds/plans but we would not necessarily have an older copy as we don't retain older deeds/documents once registered. They go back to the applicant following first registration as we are not a 'deeds repository' for example.

    The important think with any plan, and especially any plan with markings on it, you need the words to provide the context as to the plan's purpose/meaning for example.

    People may have an old deed with a plan with T marks but they are not mentioned in the deed. What do they mean if not defined and no context provided?

    The old deed may refer to for example a covenant by A N Other to maintain the fences on sides mark T. But that was in 1967 and the owners have changed a number of times since - so is that covenant and plan still binding?

    Be interesting to read what context or importance the Sports Club applies to the plan


    Thankyou again. I have just been round and seen the plan they have-it doesn't actually cover the boundary in question but actually it is a mark against a garden that must have existed where my house now is..my house appears to be on what was 2 thin gardens and the T mark is on one of boundaries of one of these gardens. The hedge in question is on a field further down the line than this which has it's own title deed and the T is not on this area on any of the plans we have between us i.e my current house and field plans, their current one or the old one from before my house existed. One of the members was trying to say it was my responsibility whereas the other was a bit sheepish and said it wasn't clear. I have said based on what they have got it seems to me it is shared and we should go halves..I have to see what the committee say now...so far I am still invited to the end of season do! :rotfl::T

    Long story short our mortgage offer is nearing its expiry and a TP1 form was submitted today ref VA1535F.

    I was wondering if you could confirm the current working time for these requests and whether or not the sellers solicitors could request to expedite?

    I only ask as they have given us estimates of 12 weeks and advised that it would not be able to be sped up even if they requested this.

  • @Land Reg, it may not have been a TP1 but that ref is regarding the property in Question. Sorry new to all this and trying to get info out the solicitors is like getting blood from a stone.

  • The application was only submitted today. I suspect it will need all of the average 9 working days before it is fully considered as the application is to disapply the restriction(s) so will need referral to a senior office/lawyer

    Thanks for the reply, does it mean, that it will be done in 9 days so we can proceed to the exchange?

    That all makes sense and mirrors what is often the reality for many dealing with older properties.
    Clarity of plan and deed are one aspect but so too is clarity of understanding and appreciation of what is set in stone legally and what is not. That can be very subjective in my experience as the land/property, the boundaries and all the owners are unique and can have different views - hence the need normally to share, discuss and agree a way forward as you are doing.

    Traditionally I have always favoured the tea and cake discussion but an end of season do does very well indeed although the table plan may give you a clue as to how things are panning out!

    I also use the tennis match analogy a lot where the boundary is the net and two neighbour's play out a game where each can hit the ball (discussion/actions) back and forth as they see fit. An ace is rare in my experience and in some cases it can be a very long rally

    Sadly not - the 9 days is an average only. Everything depends on the supporting evidence submitted and whether we need to do any wider checks. We don't take 9 days to think about it but that tends to be the wait time between receipt and full consideration. But it is an average only.

    It is TP1 application submitted on 2nd Oct and they have asked for and had it expedited.
    That reduces the wait time between receipt and consideration considerably to around 10 working days. Then it all depends on it being in order.
