Hello.. can anyone on here point me in the direction of someone who knows about Scottish Property law, and in particular, how burdens are recorded (or not) on registration of a title.
Many thanks. D450 -
My wife and I currently own our home as joint tenants. There's no mortgage on the property. My wife's mother has financially contributed to the cost of an extension that's been built on the house for her to live in. We'd like to add her as a joint tenant in the ownership of the house. What's the simplest way to do this without getting into expensive solicitors fees? Thanks!0

Our online guidance explains how to transfer the legal ownership
Whilst legal advice may appear expensive it is important to understand the impact of such a transfer on each of view and to discuss what happens next in any future scenario.
The advice can also assist with unfamiliar firms and processes and can also assist with verification of your identities
You don’t have to get such advice or help but we’d always recommend you do“Official Company Representative

Would it be better just to register a charge on the property for the amount she has contributed to the extension?
In case she needs the money in the future, plan for how you would repay it - a mortgage or savings, etc.0 -
Hi again... I may be in the wrong place.... could someone move my post #1966 to the relevant forum for Scottish Property Law, please?
Kind regards, D450 -
I'd like some advice please. We are in the process of buying a new home & along with the contract, our conveyancer has sent a print out from the land registry for us to sign to confirm this is the property we are buying. The problem is that the name of the house on the land registry docs is different to the one currently being used & what is currently on all documents, bills & council tax. No houses in the the road have numbers. We have sent back the contract, but not the land registry form & emailed the conveyancer for advice, but haven't heard back yet due to the Christmas break I expect. Should we be shown documents confirming the change or should it revert back to the name on the land reg docs? We are a bit uncertain & not happy to sign it as it is.0

You'll need the Registers of Scotland but appreciate you will know that already.
Whilst I have seen posts referring to Scottish land on MSE I have not seen any within this specific thread so it may be worth posting a new thread to see if others can assist“Official Company Representative

Check the wording of the letter or query with the conveyancer as they are normally referring to the registered extent matching the actual property boundaries on the ground, as davidmcn has posted.
If the property description differs but it's the right plot then simply query this with them to ensure you have the right postal address. And ask them to ensure that the register is updated as and when the register is updated.
If you are securing a mortgage against the property you'll probably find that the lender and conveyancer will want that detail updated before they complete anyway. But the conveyancer can advise“Official Company Representative
