In response to the "evidence pack" Gemini Parking Solutions have submitted:

In making their assessment I ask the POPLA assessor to consider the following in further support of my original POPLA appeal as submitted on 29/08/2017:
1. No NTK has ever been served and as of today there are 67 days since the PCN was issued.
“We can confirm that in regards to the appellant’s comments about the NTK does not apply as Gemini had received an appeal on the 27.07.17- (26 days after the PCN was issued).
They admit there was no NTK served!

2. No evidence of Land owner authority.
There seems to be no valid copy of an unredacted contract included by Gemini as requested in my appeal at point 3. The contract does not state anywhere that is a land owner authorisation ,it is between GEMINI PARKING SOLUTIONS AND A MANAGEMENT COMPANY OF EST VILLAGE DEVELOPMENT, it is not signed by any parties and it is redacted as there are many paragraphs which are covered by a black line, therefore it has been edited.

3. Signage
Signage- The colours blue and yellow are specifically mentioned in the BPA Code of Practice as the sort of bright colour contrasts to avoid. Use of capital letters and mixing large and small font are also deemed unclear as far as signage is concerned. Gemini Parking Solutions have mixed this into their signs despite the fact they appear to be new and should match the requirements of the BPA CoP.
Furthermore it simply would not be possible to read any signs whilst in a moving car, and certainly not have read them sufficiently to have be deemed to fully understand the T&C's to which it is alleged I agreed as the registered keeper of the vehicle. Gemini's own 'evidence' photos shows their signs clearly where you can observe my comments.

In consideration of all the evidence before me, I respectfully request this appeal be upheld.

Hi everyone. Really hope coupon mad or anyone really could tell me if this would be ok as a rebuttal for their evidence pack. I will putted down in their space on the portal as coupon mad has advised me.

I just read their email again and it states that i have 7 days from the date of the email, so my 7 days will expire tomorrow.

The rules relating to service require delivery by 4.30pm. an email received at 5.33 on 31/8/17 is therefore deemed served on the next business day (i.e. 01/09/17). 7 days from then, actually gives you an expiry of 4.30pm (assuming you serve by email) on 08/09/2017. But don't leave it till the last minute/second...

Technically valid service requires you to ring up to check the size of the attachments you send, too. You may therefore want to make that enquiry for completeness.

Just send it, in the Portal, it's only last-gasp comments, so doesn't have to be perfect.

I know from experience, the Portal only stays open for SIX days from the email from POPLA so I hope yours is still open. Obviously, if not, email your comments.

The only point I would make is have the word 'comments' e.g.:
