Hello everyone first time poster here

a penalty notice from Indigo for parking in a bay before 9.30 without having paid the appropriate fee was stuck on a car. .

    Send the usual appeal as set out in the NEWBIES thread. Do not name the driver, do not talk about what happened, and just un-tick 'driver' on the Indigo appeal page and put 'N/A' in the driver's details boxes.

    At POPLA stage, copy a recent one and start by telling POPLA that the 'penalty' ticket impersonates authority like the version I showed here (this is for second stage ad is NOT the whole appeal for POPLA, just one point of about six we always use):

    These appeals stages will be nothing like what you have just written to tell us. NOT about what happened.

    Start with the NEWBIES thread which is in capital letters, begging newbies to read it first, when you clicked 'new thread'.

    I assume that the lower rate would still apply on appeal if I am rejected.
    You wont be PAYING! Who cares about the bribe/discount deadline, why do people keep mentioning it about a scam ticket?

    Im posting for the first time.

    I've received two tickets from Indigo for two seperate occasions. On both occasions the payment processes provided were not working. I'm a blue disabled badge holder and I was instructed to ring a number with a location code. I did so and the payment still did not go through despite there being funds in my account. I have been on holiday so I've come home to the letters they've sent. I've gone way past the appeals process and they've said that they'll get the lawyers involved if payment is not made. They said that I have breached a bylaw and the matter can be criminally enforced. Unsure if I should pay or ignore. Any advice would be appreciated. Thank you

    Dear Coupon Mad, Thank you for taking the time to reply. I will definitely follow your instructions. I do however have 2 questions. As I am using the online appeal page admin.parkindigo.co.uk/indigo/pages/appeal.aspx[/url] it asks for reason for appeal. Which one do I select?
    Is is "A valid authorisation to park the vehicle had been issued"

    Lastly if I uncheck "were you the driver"

    The following pops up requesting driver details what do I enter?

    If you have not identified yourself as the driver at the time of the parking incident we are entitled to request details of the vehicle keeper from the DVLA and exercise our rights under section 4 of the Protection of Freedoms Act (POFA).

    Thank you Redex. I found the information about what to enter when it asks for drivers details.
    "More importantly, you haven't asked about the fact Indigo's appeal boxes ask for the driver's details so we hope you have realised NOT to give a real name and to write 'the driver' for the name of the driver and 'I do not have to give the name and address of the driver' (in the address box for the driver)."

    Might have to go with Darth Vadar :-)

    What I could not find on any of the newbie threads is what I need to tick at the top of the page. I did buy a ticket but according to Indigo it was not the right ticket.

    Reason for Appeal:
    A pay and display/POF ticket machine was faulty
    A valid authorisation to park the vehicle had been issued †
    A valid pay and display ticket was purchased and displayed †
    A valid payment was made †
    I have a valid permit †
    I was displaying a valid blue badge †
    I was loading/unloading †
    I was on Police/Fire/Ambulance emergency †
    The restriction was not clearly signed or marked
    The vehicle was not parked in the location at the time and date the Notice was issued

    well , the driver has seen the signs and the bay markings (or lack of) and so what does THE DRIVER think is the appropriate box to tick from the ones listed above ?

    or what is the shortlist from the above ?

    we werent there , so cannot tell you

    and edit post #1 to remove any hint of who was driving

    the correct terms for any "story" are

    THE DRIVER

    THE KEEPER

    THE REGISTERED KEEPER

    THE OWNER

    THE HIRE COMPANY

    etc

    seems to me that if a payment was made then they accepted the contract to park, so maybe

    A valid payment was made

    or

    The restriction was not clearly signed or marked

    so depends on if you go with the payment made option or that the restricted area was not properly signed option

    doesnt matter too much as the aim is to get a POPLA code (they are unlikely to cancel)

    its also about stringing it out past the 6 month deadline for thw TOC to take you to the magistrates court for an alleged bylaw breach
