Delivered 2 By Mistake

Think this is the right place to post this.

I ordered something from Curry's last week and they delivered 2 by accident.

At the weekend i received an email recognising their error and asking to arrange details to recover it.

I emailed back saying it can be picked up weekdays after 7pm due to me being at work or weekends.

They then sent a reply saying they can only pick up Monday-Friday 9-5. which obviously doesn't work for me. The box is too large for it to be picked up from work, nor do i want to carry it to work as i get the train. They also said that i can take it to a drop off point for it to be picked up.

I sent a reply saying this wasn't acceptable for me to do this due to the inconvenience it would cause me to take it to work or the cost of petrol and use of personal time to take it a pickup point.

Just received a voicemail saying they really want me to take it to a pick up point which again is not an option for me unless they're going to compensate me for travel costs and time due to this being their mistake.

Just wondered what my rights are on this? I'm not blocking them from recovering their items, they just have to do it on my terms when i'm in. I don't feel i should have to inconvenience myself for their mistake.

    You can't keep it.

    Have you asked them to cover your expenses if you was to take it to a pick up point? Fuel/parking etc?

    Contact them again with something such as:


    "As I previously informed you, I am unable to make the item available for collection before 7pm on weekdays.
    I have checked on your website and when ordering goods from you for delivery, you are able to offer delivery slots up to 8pm 7 days a week so you must have vehicles and drivers available to collect at a time that is convenient to me.
    Whilst you may not wish to use one of these late or weekend times due to your incurring extra costs, this is neither my fault nor my responsibility."
  • I understand i can't keep it and that's fair enough, but yeah i asked if they were willing to pay petrol costs etc.. but they ignored it.

    It was their error therefore the return of the goods should be at your convenience and their expense.

    Perhaps also throw in a reminder (if you're saying its a big box) that you will not be storing the goods indefinitely, so they should arrange collection sooner rather than later.

    Really, you'd have to send them 2 written notices before disposing of the goods, but hopefully pointing out the above will encourage them to get the finger out.

    Can you price up a suitable taxi fare to the drop off point ? You might not even have to go with it.

    If the item is so inconvienient to take to work or a pick up point I'm assuming it is an awkward weight or size, why then were two items accepted? Wouldn't it just have been easier to reject one of the deliveries? You say you got an email when they realised their error, does that mean that you didn't even bother to contact them when you received the second one and just waited for them to notice?

    How about seeing if a relative, neighbour or friend could either be at your address to hand it over to them or arrange collection from one of their houses?

    Unfortunately you don't have a legal stand point on this. You can not keep the items, as said before the extra package should have been reported straight. If this is in regards to a certain gaming component I also had the same happen I took both packages as the item I ordered was a bundle and I had assumed it came in 2 packages. As soon as I found out I called Currys and had it collected. They do their collections with DPD who can only collect between 9-5 Mondays to Fridays so Currys could do nothing to change that. DPD have a range of pick up shops available to use. They are the things they can offer so you have to find a way to do one of those unfortunately. If not you are legally responsible for this item as it was accepted and not reported by yourself and if it is not returned is counted as theft. You can speak to them about compensating for the inconvenience, but again your have no legal stand point to receive this. My advice is return the item as soon as possible.

    How did Curry's deliver it if you aren't in before 19.00 on a week-day? Presumably you took time off work or someone else was in to take delivery. Understandably you would not want to take time off work again to mitigate Curry's fault, so Shaun's or Geoff's solutions seem to work.

    Don't be silly. If OP was refusing to return it, it may be treated as theft. But not where OP is willing to return it but the company aren't willing to send someone when OP will be available.

    This situation is covered as an involuntary bailee. OP has to take reasonable care of the goods and make them available for collection (at his convenience & the traders expense), thats it.
