Not wholly in bay

Hello all,

I’ve just had a PCN for being a bit stupid.
It’s for not parking wholly within the bay, there is clear signage saying ‘park fully within the bay’. My wheel is on the line and the rear bumper hanging well into the space behind but there’s still space for a car to fit into that space.

I arrived at half 5 in the morning, knackered and wasn’t thinking but I think they’ve got me banged to rights.

It’s for £60, Premier Parking Logistics, if I pay in 14 days. Is there any point appealing or shall I just pay?

    You should only pay after you have stuck pins in your eyes. Have you stuck pins in yet?

    sorry I did read the sticky but it seemed like that was for complaining where the car park had made a hash of the PCN / signage etc.

    I've contravened the rules and they are IPC registered.

    Did you actually see this "park within bay" rule when you arrived?

    Why does that mean you should pay them money?

    It's a bit harder this time since most of the within bay issues are over a few mm (they are that bad).

    Have they done everything to hold the keeper liable? Do they have a contract to issue invoices?

    Do not pay them. Just follow the advice from the newbies thread, and in this case, complain vigorously to the hotel in question about the behaviour of their agent.

    I did see the park within bay rule..

    It's a very tight car park so I was overly cautious about blocking the space at the front of the car but horribly mis-calculated it.

    Ok so the advice from the newbies sticky is to send that email appeal. I suppose there's no harm in doing this however it's asking for photos that I can already see through their website.

    I've got 14 days to get the cheaper price so let's see how quickly they get back to me.

    There is no "cheaper price" thats a con to get you to pay quickly. Use the templates, they are framed from a legal perspective. Most companies use rubbish signage but the lay person doesn't know the rules so thinks the signage is ok.

    Why do they think you owe them any money? They are scammers pure and simple. and make their money trying to con money off the stupid and the gullible. The produce nothing and contribute nothing.

    If you parked thusly in a Council car park it is unlikely that they would want more than £30. and LAs have the law behind them, these scammers do not. .
    You never know how far you can go until you go too far.

    my assumption would be that by parking on private land I've entered into a contract to abide by the rules displayed on signage.

    You assume wrong. In order for it to be binding the PPC has to follow certain rules. Given very few of them follow the rules then the signs aren't binding.

    ok thanks. It looks like the first step is to complain to the landowner. As there is no shop on site, it's basically a building site with parking bays how do I ascertain the landowner? presume it's not the same as the PPC?

    Highly unlikely to be the PPC. Try asking the building company, they should know.
