It's amazing what you hear at the hairdresser when the staff seem totally oblivious to the fact that we can actually hear what they think only they can.I would NEVER make negative comments about the business etc in front of clients.
Funnily enough, it happened only last week. I was waiting for the colour to take in my hair and needed the toilets which are right next to where they wash hair. There were no customers and one was cleaning the area whilst my hairdresser was chatting with her. What I head them say, I certainly wouldn't go and repeat, but if they'd realised I'd heard it all, they would have been horrified!0 -
I agree. So in the OPs shoes I would avoid the solicitor because that will cost them, and they really need to settle before a tribunal. I'd simply go with unfair dismissal on the basis of not following a fair process, and denying a right to representation, and accept a low offer but with a good agreed reference. Which means they'll have a reference to get another job. And then learn the lesson - it doesn't matter what your employer is like, you don't have a licence to slag them off.0 -

Sorry to clairfy - the moaning and b!tching (!) was done between us, not in front of clients. Thats why were guessing he's secretly recorded it and using the client as the excuse. I would NEVER make negative comments about the business etc in front of clients. Sorry just really upset and maybe not explaining properly

As your employer they can do what they like - whether it's legal or not is a completly different matter and, now that they've done it, it's up to you to fight for your rights0 -
I would say its worth pursuing through ACAS at least to get your notice pay. Whatever the reasons for the dismissal, the way they did it was "unfair". There're procedures they need to follow and if they haven't then you should pursue it.0

You have already been told that they can't do this without a fair process. The issue is, what can you do about it, and what you said IS relevant to that - as has also been explained. The employer can equally argue that they deserve better conduct from their staff than making negative and detrimental comments about them, and a court is going to agree with that view. After four years employment you should also know better. This is not all about the "nasty employer". So if you went to a tribunal they will take certain things into account - one of those will definitely be that, as a small employer, he isn't as aware of the law as a big one; and another will be that you actually did this. With those two things together, you could well be taking a risk on a pyrrhic victory where you win but get nothing!
It is all very well being on your high horse about how he shouldn't have sacked you like this. He shouldn't. You should have given him cause to sack you, and you did.0
