OK, if you have been there five years then you are, at the very least, entitled to five weeks notice (or pay in lieu).
By saying they will pay you to the end of the week they are admitting that this is not gross misconduct. I would act dum about that point for now but it could certainly be part of any claim.0 -

Nope, Ive not had any warnings, disciplinarys or anything of that nature at all.
That was in response to my post about past issues.
I mentioned being sacked after being there for 5 years was a bit harsh but then thought as it was gross misconduct maybe it wasn't (I realised I'd stepped into terrority I wasn't familiar with so removed the post).0 -
Sorry to clairfy - the moaning and b!tching (!) was done between us, not in front of clients. Thats why were guessing he's secretly recorded it and using the client as the excuse. I would NEVER make negative comments about the business etc in front of clients. Sorry just really upset and maybe not explaining properly0

To be honest, I think it's not a good case then. Technically, dismissal without notice of a disciplinary hearing g and being told you have the right to representation is certainly unfair in law. But the chances are high that you will be seen as having "brought this on yourself" by your actions, so any compensation from a tribunal would likely be reduced or wiped out.
And I'll tell you how he knows. He knows because the person you said it to told him! That happens far more often than secret recordings! What on earth made you think it was ok to slag off your employer whether customers are there or not? Of course you can be dismissed for doing it! If you don't like your employer, whinge about them off the premises and in circumstances where it will NEVER get back to them. That means not on the premises, not on any form of social media, not with people you work with, and not where anyone will hear you that could repeat it.
If you attempt pre-claim conciliation through ACAS you might get an offer, but I wouldn't push your luck because if this goes to a tribunal I think it would be very risky for you.0 -

Or perhaps one of the other people in the conversation decided to tell tails, or perhaps the owner overhead a comment and you was not aware of their presence. Either way it does not matter.0
