Sacked on the spot

Im quite upset as I have been sacked on the spot today for 'gross misconduct' after my boss apparently received an email from a client (im a hairdresser). He refused to show it to me or reveal who sent it, but from the parts he briefly quoted to me, I can only come to the conclusion he secretly recorded us talking at work then used the email as an excuse.

Im really upset and scared, can he really do this? Secretly recording staff is one thing, but Im sure he cant secretly record conversations that include clients too?

They are only paying me until Friday last and said to go home today and not come back.

Is this legal and cant I do anything about it? :cry:

    When did you start working there ?

    Do you know for sure he recorded you ?

    And, did you do it? I assume that if you think he recorded you, then whatever you said that caused the dismissal, you did in fact say?

    Worked there since May 2012, I dont know for sure, but some of what he said I know I only said to my colleague, not in front of clients.

    What hes sacked me for is general !!!!!ing and moaning about him and how he treats us... Im sure if everyone who moaned about their boss was liable to be sacked there'd be no one working at all!

    So you don't actually have any proof of that?

    It is not unlawful to secretly record a conversation you are party to. It may however be unlawful to covertly record a conversation when he was not present. Even in the former case it would generally be unlawful to "publish" the recording to any third party as it could give rise to a civil action under the ever evolving privacy laws.

    That said, there have been occasions where transcripts from such recordings have be admitted as evidence at employment tribunals.

    That may all be academic in any case, depending on what is in the email.

    How long have you worked there? If less than two years then it is all irrelevant as you can be dismissed for no reason at all.

    Unless it is gross misconduct, in which case you are not entitled to any notice, you are entitled to a minimum of a week's notice increasing to one week for each full year of employment (up to 12) if you have been there two years or more.

    Notice begins the day after it is issued to technically it should include next Monday as well.

    Must have been a terrible work place to have worked there for 7 years....
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    To clairfy - if he has recorded us, he was NOT present - it was us talking amongst ourselves and with clients.

    They have been mostly fine to work for, they have had their moments but this has come out of the blue even for them... and it was a typo, been there since 2012, have edited it.

    Nope, Ive not had any warnings, disciplinarys or anything of that nature at all.

    TBH I think it would depend what you said or what the email says you said. If you simply said "he's a pain" that's harsh but still bring the company into a bad light.

    If you for example had said he fills the good shampoo bottles with cheap rubbish and sells them on full price. ( sorry trying to think of an example )????

    Moaning and B*tching is one thing but it should never be in front of clients no matter what he has done. After all you are bringing him and the company's reputation into doubt.
