    Someone with more knowledge of BMW's algorithm can maybe comment but my previous VW/Audi/Merc/Jaguar ones are still based on a maximum mileage/age and dash display won't let it go further than that without showing 'service overdue' or similar.

    This wouldn't be recorded as such in service book but may be on an online record the manufacturer holds

    even if so, can't i argue that in my user guide it doesn't state that?
    either way, this all happened before i owned the car, i didn't know such a thing existed lol

    You bought the car without sight of the service history.
    You cannot simply state that it is not your fault a service was missed.

    A missing service will have a detrimental effect on the engine, but that effect may not become apparent for some time - as you have found out.

    i disagree somewhat, it had service history and was serviced at each other the mileage markers - i didn't know there was a time delay between these and when the garage told me FSH then i assumed ... maybe i should've read up a bit more, but i didn't

    I'm on here anyways, looking for a bit of help and not a slagging that i didn't fully understand the servicing requirements of a car please especially since they aren't stated in the manual - the car also did come with the service book, i had just lost it.

    or am i screwed...

    Unfortunately it seems that way - warranty companies will do anything to wriggle out of claims. Your only avenue might have been the dealer you bought from but after a year this is unlikely to get you anywhere :(

    Just for future reference this is very bad for a car engine. Oil should be changed yearly if someone is looking after their car and should be changed more often if being used for low miles.

    So you have a modern diesel engine which was being driven low miles (only 6k a year) and not being serviced for 3 years!. That is likely to cause alot of problem in the future (if it gets fixed).
