hi, looking for advice
I bought a car with full service history from a garage. but lost the service book.
So i emailed BMW and they sent me a list through of my "service history"
I then sent this onwards to my third party warranty company "warranty wise" who said that was fine
I have now had a failure and I'm trying to claim my warranty. they have stipulated because my car was serviced within mileage and not within "2 years" (this was before the car was owned by me) that I infact do not have full service history and they wont pay out. the car wasn't serviced between end of 2011 to start of 2015 but it only moved 18k miles then it was serviced. since then its been serviced and ran a further 18k without issue
the email from BMW does say "service history" on it - but on checking, the additional mentions are "MOT, and "health checks"
heres what i've managed to think up so far
There is no where in my bmw manual that states the car should be serviced every 2 years so the warranty company can't use that surely? its what bmw say when you phone them but its not in my manual?
The garage, who sold it as having FSH is also at fault however, i don't think i have the original car advert to prove it said "full service history" so i don't think ill get far there

There is unlikely to be a legal definition of Full Service History - so you're on a sticky wicket to start with. If you'd asked the question of the seller (and BMW) has the car been serviced as per the manufacturers specifications ? and they'd answered 'yes' then you may have a leg to challenge with.
In the meantime what's the car/age/issue etc and how long have you owned it ?0 -
09 plate, 1 year , bmw and its a failure of the conrod in the engine block that has damaged the crank and a shell off also0

So it's 5 years out of BMW warranty so no goodwill from them
Which model ? how many miles ? What are warranty/dealer saying is the cause ?0 -

its the 335d, and the warranty is with warranty wise.
The warranty company have said the cause was lack of servicing - but this gap in servicing was 2 years ago, and the car has been serviced since and also run for around 17k further
they are sending out an independent tech, but as its engine related i suspect they'll just say the same. even tho it was years ago.0 -

I would have thought that it's what was written in the service book and not what is in the manual that is important.
As the original book has been lost, you have no way to know for sure if this stated that a service must be carried out every X number of miles/every 2 years whichever came sooner.0 -
So it's an 8yo performance diesel with presumably fairly significant mileage on it ? It's been serviced outside the dealer network and/or missed a service but you've paid top dollar for it on the back of a promise of Full BMW Service History ?
Given you've had it a year is this at the end of a Warranty Wise period or the start of a new policy ? Whichever it is I'm not getting a feeling there's a lot going for you
And if it helps I've run similar age performance diesels but only with meticulous checking beforehand and covered by manufacturers warranty - I hear too many horror stories of 5 figure sums when an engine such as this lets go0 -
it states in the users manual - that the servicing of the vehicle is done by how you drive it and is calculated in an algorithm.0

67k so below average for a 9 year old car
its been outside a dealer network, but serviced via cotswold group
its 3 months into a new policy. after my original garage failed to pay out on a warranty claim of the drive shaft (chariots specialist cars) i moved over to find another warranty company0 -
they've said, if it proves that the lack of servicing 2 years ago isn't to cause for a failure of the conrod they'll revist the claim when the technician is out. "sudden mechanical failure and not wear and tear"
i would like to think i can argue a conrod breaking, isn't wear and tear and is infact sudden mechanical breakdown0 -

a friend checked his book, his doesn't0
