    1 is a bit misleading as it says defective or incorrect - where as the law would cover slightly more circumstances than that (basically anything which means the goods do not conform to contract). But it will cover your situation (assembling the products shouldn't make a difference to that as they don't conform to contract).

    2 cannot be used as a get out - you had a contract for them to supply x goods in exchange for £y. They haven't provided x - they cannot use T&C's to disclaim liability for goods that do not conform to contract. Nor can they vary the terms of the agreement (once it has been agreed) without your agreement.

    Tbh the pictures you link, the pillows look like the type you'd use on a bed. I'd say its definitely different enough to not conform to contract (wouldn't even be any doubt in my mind). However I would contact them first making them aware and perhaps asking if they've made a mistake in sending the wrong back parts as it should be a cushioned pad rather than a pillow.

    To be honest OP, those firm back cushions don't look at all comfortable. The soft "squishy" ones look much more conducive to relaxing, but if you like the others better why don't you just try asking them to change them rather than send the whole thing back. They even just send you the new cushions and not ask for the others to be returned.

    Two sets of friends of mine recently bought similar style furniture and in both cases the back cushions are soft and comfy, also the delivery driver assembled the furniture and took all the packaging away!

    Thanks. I intend to contact them tomorrow. Should it tune out they have sent thme correct items, where do I stand on the £49 the claim will be charged if I have to send it back?

    as LadyDee says, the firm back ones don't look comfortable, you don't always sit with your back straight, you need a wee cushiony puffy up thing for your back.

    If they need a wee bit bulk, check out the charity shops for cushions and stuff them in.

    It is clearly the wrong cushion.

    (But does look more comfortable!).

    Phone them and see what they say.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    The £49 charge is for change of mind returns. In your circumstances, its not a change of mind return as the goods don't conform to contract. Which means that the retailer is in breach of contract and as such, is liable for costs incurred due to that breach.

    If I were in OP's position, I'd want what was advertised and then probably buy my own cushions to use to provide more comfort. Personally though, I tend to only use cushions as decoration as they annoy me when sitting down.

    Whats been provided though looks like a bed pillow imo. Typically sofa cushions/pads are more filled as it needs to support a lot more of your weight than a pillow (which just supports your head/neck).

    To my eyes clearly not as described and the different pillows will make it look different (and unpleasant). They should be replacing just the cushions for you.
