Advice wanted/needed please!

I have been reading through a number of threads trying to find out information about my situation so thought I would write here. I've tried reading the newbie pages too but to be honest, I found them confusing and rather daunting so let me explain and maybe we can go from there. :)

I am the registered keeper of a vehicle which, on 11th July, had a so-called 'ticket' placed on the windscreen by myparkingcharge.co.uk - you know the one I'm sure with a reference number and date. After reading some posts on here, even as the registered keeper, I didn't do that and as I write this, I still haven't. I am told the car was parked immediately infront of one of the information poles (sorry not sure how to describe them) but taking up more than one bay wasn't on there and I believe from what I'm told that was the reason (or possible reason) although I've not seen any photos, I would dispute that.

Today, I have received a parking charge notice (PCN) notice to keeper (NTK) demanding £100 and which confirms the contravention reason is 24) not parked wholly within the markings of a designated parking bay.

Before I do anything else, what would be your advice please? I would be most grateful. There was certainly nothing on the sign (yes that's the word lol) to say that would be a fine if you did it (I've been back to check) although it does refer to further T&Cs on the payment machine which I haven't re-checked yet but assuming it's not on there either, am I right in saying they have no right to use it as a contravention?

    Have you discovered the 'search this board' facility?

    would be your keywords - loads of threads all about this exact scam.

    The search box you want, is just above the sticky threads in a small header along the top, level with 'new thread' but on the right, with a little drop down search box. Literally sitting right above the thread list.

    Not the MSE search at the top of the entire page - that's useless.

    It does but it's worth it. Once you have the ammo to beat these tickets then the fear of them goes. Ita amazing how many people use the new found knowledge to help friend, relatives, neighbours and the such like.
  • Indeed so waamo. Actually whilst I'm here thanking you, I've been reading one shouldn't appeal to Excel but wait to hear from a court and ignore all else - right? Also if you have a valid ticket to post it - as the vehicle had one on that day so where should one do this, here in this thread? I'm just going to go back to the newbies thread now and re-read post 1. Hopefully now I've been reading a while, the abbreviations and so on will make a little more sense. :)

    That's what the BMPA advise and is just as good as sending the standard IPC appeal, which I only wrote under protest because some newbies can't get it in their head not to appeal! Either way you can't see it off by appeal - that is a fact.

    You MIGHT see it off by complaining quickly to the Landowners, who have the contract with Excel and can cancel one within the first fortnight after issue, no probs. Be assertive and act quickly on Monday morning to complain in the right ear and don't take no for an answer.

    All appeals to Excel will fall on deaf ears. Their trade association, the IPC, employ someone called "Skippy" from Australia to adjudicate on appeals.

    Sometimes it's worth putting an appeal in just to show you have a strong hand. Skippys reasoning for declining it can often be so outrageous they don't want a judge to see it.

    I've just been reading this .. https://forums.moneysavingexpert.com/discussion/4766249 where all (?) the given examples seem to be relevant to one large store or hospital etc. Any suggestion where the car park is adjacent to a small precinct of all kinds of small shops plus a JC and more which I won't mention for not wishing to make it too obvious. Would it be better to find out who the landowner is and complain to them or are they likely to be 'in' with the racket, in a manner of speaking?

    Finally for now (still haven't yet finished reading post 1 but will return to it in a moment) my last question is it mentions complaining AND appealing which seems to go against all the information I've been reading so far. Is it that you should only appeal if complaining to a business like was on that particular page? That would make sense then.

Unfortunately I don't have the landowners details or I'd call them on Monday but I will *try* even though I've only recently come out of hospital, to get down there and take some photos of the signage and the payment machine which I'm told has full T&Cs on it - which surprises me. Certainly the sign the car was parked under didn't have any mention of bleeding over into another bay! And then I'll be able to speak to them on Monday as you suggest. The ticket was put on the windscreen 11th July so it's not been 21 days yet. Anyway thanks for the suggestion. Sounds like a plan to me. :)

    No.

    Appeal and complain to the landowner/merchant etc where your car was parked in tandem.

    A landowner cancellation is by far the easiest way to deal with this if you can get one. See #6

    a landowner complaint is by far the best method of getting a cancellation

    if you have now received the postal NTK, then use the black text IPC template and appeal it , as KEEPER (not driver)

    this will be declined and the IAS may be offered

    if they did cancel, its over , if not , then its 6 years of waiting it out unless they issue an LBC (either themselves or a solicitors like BW LEGAL) or an actual MCOL court claim via Northampton CCBC

    if you are looking for a magic bullet , there isnt one (unless the landholder cancels it , in writing)

    this is the nature of the sc@m , which you fell into their trap when the driver parked up
