But the appeal focuses on the fact that a ticket hasn't been bought

No, it doesn't. The appeal does not even mention the issues. Deliberately. And - most importantly - nor does it out the driver.

Please read it again and stop thinking the appeal should be about the story of what happened.

that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

Quoted from the sticky. It's focusing on things like signage, but that is irrelevant if I bought a ticket. Seems pointless trying to defend it from the stand point of the signage is wrong stand point. Their signage is fine and clear, that isn't at all what the issue is, there is obviously an issue with the parking machine or the ref was out in slightly wrong.

Either way the one size fit all solution seems like a bad solution to this problem but still you push it?

I mean I appreciate it doesn't sound like I am going it get any input from this forum other than read a sticky, but it just seems like the wrong angle to approach this.

How large is the lettering? Does it conform to the code of practice?

No, it isn't. I bet the tariff was in HUGE letters. What about the £80?! Buried in small print...

Please, please just use the sticky thread version, tried and tested.

I am going back today to check. But I remember it being clear, readable and pretty large. It's not that old. But yes I will check this. It's just that attacking this aspect seems a bit fruitless.

I'm going to put this thread on ice until I know more details of the sticky can get me out, and report back if it doesn't.

It's not fruitless - it is a standard thing to raise and their issue to prove - and your version of appeal would lose.

In fact, you will win at POPLA stage, second try, on 'no keeper liability' (a completely different issue) anyway, so this discussion is moot!

Appealing as keeper will win every time at POPLA v TPS.

Why is it fruitless? If you raise a point on appeal the company has to prove they are compliant.

Nearly every sign I've seen fails on some point so the parking company fail at POPLA.

Why are you doing their job for them by measuring it? Make them show that the size of lettering is correct.
