loan and credit card mental health

hi I got a loan off 4k and a credit card a few months later 750 limit, I owe now 4k for the loan and its in 500£ arrears I haven't paid for a few months and the credit card just goes up.
I have had serve mental health issues for 10 years and stand on the side of they should not of givin me the loan and the credit card I have had a history of debt and no salary was paid into the account I told them I had a job at the time earning 15k a year but this was just nonsense am on about 12k I have mental and physical difficulties on top rates and have for many years I stand by the they should not of givin me this just cos I transferred a couple of hundred quid into the account then offered me it they said I was baning with them for 10 years I used the account for about 2 months, is there anything u can help me with on what I could say to get these debts written off on health grounds, any ideas on whats the best way forward on my case?

    If you didn't tell them at the time, there's no grounds for mis selling.

    Well your illness might convince them not to pursue you for fraud. I'm assuming you forgot to mention your illness when you applied?

    Banks are not psychic.


    If you didn't tell them of any mental health issues, they will not know of them. Your medical history is of course fully private so they have no access to anything other than what you tell them.


    Furthermore, as stated, you've committed fraud by obtaining credit with false statements. The two may well cancel each other out but the lenders cannot be responsible for being mis-led, nor be liable for mis-selling on grounds that they have no ability to know.


    Write to them stating what happened and why, and come up with an arrangement to clear the debt. I don't think however that there's much grounds for the debt to be written off, but if you can get a doctors letter stating that your judgment was impaired at the time of application due to mental health issues, it may help.

    Written off lol, more like you run the very real risk of being prosecuted for fraud if you try to go down that route.

    Best thing would be to either arrange a repayment plan you can afford, or use the help of a debt charity to to this. But the loans do need to be repaid.
    The instructions on the box said 'Requires Windows 7 or better'. So I installed LINUX :D:D

    Until the day comes when banks have full access to our medical records (heaven forbid) I cant see how you could expect the bank to know of your conditions.

    Further, even if they were aware I'm sure you wouldn't want them to discriminate against you and refuse your business becasue of your mental health.

    Its not often I feel sorry for the banks but in these circumstances they just cant win.

    Think about it from the bank's perspective: someone who's lied once about their income to get a loan may also be lying about their mental health to get them out of said loan....

    Pay it. When you applied you committed fraud as in proper go to prison fraud. Personally I'd be keeping my head down and my mouth shut.

    Right, you've obtained money from a loan and credit card under false pretences with obviously no intention of repaying them. Rather than paying your debts, you're now playing the mental health card in the hope that by some miracle they will be written off.

    I would agree with this totally and actually I'm hoping that your bank don't write the debt off and insist on payment in full.

  • Yet again someone refusing to accept responsibility for their actions with a severe lack of punctuation thrown in for good measure.
    I have a friend who has mental health issues, it's a subject dear to my heart and they were upfront with their bank regarding a credit card and repayments. The bank have been extremely supportive, given a dedicated number so my friend doesn't have too much stress to deal with. It's about keeping a healthy relationship. You committed fraud. This isn't just embellishing your CV to make you seem a better candidate for a job. You have knowingly lied.
