I know there is an air of flippancy with regard to injury claims especially whiplash type claims and it has been much covered in the press. Let me just say this, I as an innocent party most assuredly do not wish to be rear ended by a careless motorist,nor do i want my motor damaged or to have my body jolted in such a way as to cause injury. Such situations result in material loss, loss of time,loss of earnings, discomfort pain and suffering of varying degrees and in the most serious of cases, long term effects.
The real answer is for people to pay attention and drive with due care. The driving standards are getting worse and worse on UK roads . What are injured parties supposed to do? just throw their hands up and say, oh well, it doesnt matter,,my car is damaged and i cant turn my head to any great degree due to pain and stiffness,,,its just one of those things...
We could just as well apply that to a plethora of other situations which may be of far less impact/importance...
Flight delay? oh well ,these things happen,,lets not bother putting in claims based on UK law..
Had an infected blood tranfusion?? oh well,these things happen,,its the NHS,,cant blame them..bless

No, they are supposed to claim from the guilty party's insurance. I think you miss my point claiming you have whiplash and at the same time wondering whether you should go through insurance are mutually incompatible.
Might I suggest from your post above that you are looking for a little something to cover your inconvenience and to penalise the other driver for being inattentive and nothing to do with personal injury?0 -
If the guy pays you privately you could both agree to not inform insurers. If his insurers are paying the claim will be on a central database so you must inform0

With regard to premium increases, somebody rear ended me when I was parked but the insurance company still tried to increase my premiums as I had had an accident. I moved elsewhere to avoid the increase.
For there to be two whiplash injuries, there is probably substantial damage to the bumper and beyond. I would go through the third-party insurer. I recall that they offered me £250 in final settlement of any injuries I may have had. I declined as the injuries were minor and I suffered no loss. My car was written off.

OP, for info. I was rear ended a few years ago. The other driver wanted to sort it privately as it looked like it was just a damaged bumper. Had it looked at by a reliable mechanic who said the frame was also damaged and the car was basically a write-off. When I told the other driver (the car was worth about £750) he wasn't so keen to sort it privately.
When I rung my insurer they provided details of an AMC themselves, and I used them and it was all sorted no probs. - yours might do the same. I had to declare a no fault incident for 5 years afterwards, but the premiums I paid didn't appear to be affected (they actually went down every year through shopping around). There were no injuries though.
The cost with the AMC tends to be hiked when you start having hire cars etc. plus the potential injury claims. I'd recommend thinking carefully about having a hire car as it's not always a good idea. The AMC I used (can't remember their name) told me they only deal with claims that are, or appear to be, no fault claims - yours seems to fit that category.0 -

Glad no one was too badly hurt in the accident, having just been through a non-fault claim my self recently all I can say is good luck, and mare sure you use a good AMC.
My case was recorded all on my dash cam, with liability clearly with the third party. At the time they admitted liability but 24hrs later it was a different story, even than with my dash cam footage it took another 2 weeks for the third party to change their story. It than took another 3 weeks for the insurance companies to fight it out regarding costs/settlement.
I went with a very very good AMC after it became clear the third party wanted to play games and my own insurance company was not all that helpful. It's the best decision I made, and within 24hrs of contacting the AMC things were moving, even than the AMC had to constantly chase the third party insurers, often 3 times a day, every day!!!
Total time from accident to final settlement for my case= 5 weeks!!!0
