Also, I've seen on other posts about Lay Reps and wondered if I could ask the courts for my wife to be mine as she is also my carer and the one who has dealt with all the paperwork?0 -
I am not good with all this legal stuff and pretty sure this is the wrong place to post this, but Martin says be especially nice to newbies so here goes. Potted History, I got home from work one night, my cat was peeing blood. Vets closed, so emergency vet time in a town nearby which I had never been to before. Vets on a side street with double yellows and cars all over the place as there is a takeaway next door so lots of people collecting food. I called the receptionist for advice where to park and she said that there were some spaces "round the back" which is where I went. I parked outside a closed quik fit building, went into the vets with the cat, we were both very distressed at this point, I was in the vets for no more than 15 minutes, returned home.
About 3 weeks later I got a penalty charge notice from ES Parking, there was nothing on the car at the time so it came as a big surprise. When I checked, I had in fact parked on a private road. I genuinely did not see the signs, in fact I was parked right underneath one, it can only have been my state of distress which made me miss the sign, when I went back to check, I was sure that they hadn't been there at the time so sure was i that they weren't!
I wrote back to ES Parking explaining that I didnt want to pay the fine, sent a copy of the receipt from the vet proving I was there and also confirming the short amount of time I was in and didnt hear anything for a while until I got a letter from Gladstones about the court proceedings which is now set for the 30th January.
I just wanted to say a couple of things, firstly I am amazed it has gone this far, I never thought it would and the main reason for this is because most of the posts you read say "it will never happen" - well it does and I am quite nervous about what to expect when I get there, I have never been to court for anything before, and secondly, all the very "legal" type stuff which is on the forums like this is not very helpful to the people like me who have zero experience of these things. I was always of the opinion that to make it count, you have to understand what you are doing and do it right, the jargon is impossible to understand for those like me.
So, off to court I go I guess, but I would like comments if possible on what to expect when I get there, is it now a done deal that I will be guilty and have to pay and at this late hour, is there anything else I should do or can do to be as prepared as I can be, aside from obviously taking with me all the things I need (copies of documents etc) and notes in my defence.

Yes. Both of you should go along and when you get there talk to the Usher. The Usher takes names and the cases. You simply tell the Usher that your wife is your Lay Rep as she has dealt with it all. Usher tells the judge and you both gone in.

Claiming costs - newbies thread post 2 should have a link to an example COSTS CLAIM
You re looiking for:
1) Normal costs - half day loss of earnings or leave, if applicable; parking and mileage.
2) If you can show they have behaved unreaosnably, then you can look for additional costs. £19ph for reading up, writing the defence, etc. Have a look around to see how to word this.0 -

So i think we’re ready for the hearing tomorrow.
Hopefully this time tomorrow we will be celebrating not only the end of this farce but also my successful transplant that took place last month and which has been over-shadowed by the stress caused by nothing but the greed of the PPC.
Tonight i shall relax and try not to procrastinate about tomorrow! Wish me luck 🤞🏼0 -
