    I didn't take the photos jenniefour I have them from the inventory that the letting agent gave me

    I've written a letter a polite one requesting my deposit back, I've said that due to her not providing me with Information regarding my deposit Its protection I have come to the conclusion that she has not protected it and this breaks tenancy deposit rules/laws I've mentioned the housing act etc etc. I really hope this doesn't go as far as court she can afford legal representation I'll just have myself my inventory and a note pad!

    Wait and see what response you get. If landlady has any common sense she'll be getting herself informed on her legal obligations.

    G_M maybe you could represent me? I don't have any money to pay you but I make a mean lasagne lol

    Update I got a call from her saying 'you're not getting it back' she got the letter so I said 'please put that in writing as requested already' and she dutifully did! By text lol

    Letter Before Action (final chance for her - 5 days?) and then you'll have o go to court.

    She'll lose and have to pay you the penalty as well as the deposit so she'll learn a lesson.

    You'll have to pay initial court costs, but worth it as you'll reclaim these from her as well.

  • Thanks, all the info I've read tells me to give her 'reasonable' chances etc but she has no intention to pay it, obvious to me
    The kicker for me (this may seem trivial) is she has a few properties and I'm the only one so far who hasn't done a runner following non payment of rent etc, she's never had to pay a deposit back! It's a brand new world lol and here I am paid my rent council tax and all utilities until the exact date that I left and this is how she reacts!! I'll give her 7 days then submit a small claims application to court! Didn't want to do this but I am entitled to that money back I'm not letting it go!

    You can use Small Claims procedure to reclaim deposit - but not the penalty.

    Would I have to go to the CC to get a better chance of getting it back or would small claims suffice??

    Why not? After all, she didn't give you any rent reduction for those blinking furry things that moved in for a while, most people get to choose who they share with.

    Good template letter on Shelter, quote her text in there - that's not going to do her any favours in the small claims court.

  • Hey just an update I haven't sent the second letter yet thought I'd give her the 14 days to be reasonable!
    I got a call today private number went through the whose this etc, claimed to be her legal rep (gave me a name probably fake) and to inform me that she was transferring all assets to her husband due to ill health. I said 'ok I'm still going to pursue wish her well for me' and I hung up
    I don't believe the call to be from a legal rep but even if that was true her husband is named on the tenancy as a landlord it says 'tenancy agreement between myself and his name and hers. so pretty sure he's liable too! what a drama this is turning in to!
