You include it always in the defence
There is no PII contained ina tenancy agreement. No reason to sign data protection. Thats yet another misuse of DP.

I have received a copy of the DQ from the claimant but am yet to receive mine from the court. I have emailed but that can take up to 10 days and nobody answers any phones. Does anybody know how long do you get to respond?

We have now received information from the SAR request.
It turns out the car parking company were the ones who sent a 'circular' to all tenants introducing themselves as 'the car park management company'. There was no letter from the housing trust regarding a 28 day notice that is stated in the tenancy agreement. Basic mistake!

The circular also mentions permits which are no longer given out.

I believe they are going down the route that I was parked blocking emergency exits, (area marked in red on a flyer apparently sent from the housing trust to residents 2013. I am currently trying to establish how this flyer was communicated to residents as the tenant does not recall receiving it) I am also awaiting a colour photo from the housing trust as they sent it in B&W!!!!)

As the parking company have no rights in introducing changes that effect residents tenancy rights am I right in assuming that even if i was parked in the wrong area this is strictly between myself and the housing trust not a third party??

    Your input is greatly appreciated

The best advice I can give is 1) Read the thread that tells Newbies to read it first. 2) Start your own thread rather than hijack someone elses. Answering multiple people in one thread leads to confusion all round.

It really would help if you used one username consistently.

You started this thread with Lisamrie.
    On 30/7 you used MrsG2711.
    On 31/7 you used Lisamrie.
    On 1/8 it's back to MrsG2711.
But later that very same day you used Lisamrie again.
And now today you're back with MrsG2711.

    Crazy.

Log on to MCOL and see if they've sent your DQ out.
If they have and you don't have it, just download it. Form n180 from memory. Easy.

I am getting ready to write up my witness statement regarding a parking ticket where the tenant has parking for herself and visitors written in her starter tenancy agreement, but have a few questions:

    1. Can I reference verbal information supplied by tenants if they offer their name and address?
    2. Do the courts recognise the possible conflict of interest in the Directors of Gladstones solicitors and the IPA being the same, although it seems that there were changes in May 2017 but my ticket was issued before this change.
    3. I have requested boundaries of the parking area that is supposed to be patrolled as I believe the place I was ticketed is not in the jurisdiction of the parking company, I have written to land registry for confirmation and the housing, is there anywhere else I can get this information from?
    4. In my defence I asked if I could add to it at a later stage as I was not in possession of all the facts. I now have a circular that was sent to the tenants from the parking company letting them know that they are now 'managing' the car park, it does not even say who they have been instructed by. This is surely proof of breach of tenancy agreement as the housing trust did not even write to tenants introducing the parking company. Additionally, just for kicks, I also have photos of the parking officer, blocking the entrance/exit whilst ticketing, proving that he has no regards for the rules he is there to enforce.
