  • Yes- the cases where no parking is permitted. Where this occurs is trespass dressed up as contractual. Worth pursuing?

If the signs are forbidding then of course it’s worth pursuing. You will need to be able to argue it so need to understand the issues.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • BW legal regularly calling and leaving voicemails 2-3 times per week- despite the fact that I am engaged in written communication with them.
Tempted to call them to request that they stop this as it is just harassing me.
    Advice?

Write to them and request that they MUST cease and desist IN telephoning you and all correspondence must be in writing, and should they continue to telephone you then a formal complaint will be made to the SRA.

Point out that you require any such correspondence to be in a WRITTEN format due to the stage this is at.
  • If this is to your mobile, save their number as a contact and then block it.
  • Did this a while back. Now they call from different numbers and sometimes I just get voicemail without a ‘missed call’ or number registering. I don’t know which type of technological sorcery they are using for this.

Complain to your line provider and report them as nuisance callers. Ofcom can deliver a nasty fine!

    New letter from BW
    Chin up.
  • Update. Responded to Letter of Action. Requesting full explanation- trespass or contractual; calibration info; landowner contract; advertising consent; full cost breakdown and dismissing EvL and CPS v AJF as irrelevant.
I've now recieved a bunch of photos. Some taken years ago and in a completely different area of town (this 'car park' where no parking is allowed must be extensive and span 2 or 3 streets. And a map stating there are 17 signs- there were only 4 on the bit of land in question (the driver reported that these were obscured by other vehicles which mysteriously vanished by the time they returned)
Also a letter which does not mention trespass or contract, refers merely to the 'contravention' of parking in a restricted area. They state that the landowner contract is a legally privileged document which I have no right to inspect; their client VCS is the 'lawful occupier' of the land and manages this 'car park' in a reasonable manner and lastly a repetition that they will rely on EvL and CPS v AHJ etc.
They ignore everything else and give me another 14 days to pay.

    Do I respond or wait?
    Chin up.
