    Yes they can.

They can yes but he should have had another ESA50 form to fill in, i'm guessing he's had one and sent it back? Including the evidence to go with it?

Yes they can...but I feel it's very unfair for claimants to go through WCA very frequently. For them, it's getting people off sickness benefit!

OP - do send the evidence as poppy12345 suggested.

I feel it's very unfair to the tax payer that all claimants are NOT reviewed more regular, it should be ever 3 months!

And who would pay for this excessive testing? Do you have any idea how much ATOS/Capita are paid for carrying out tests for ESA and PiP?

And what would be the point of testing me every 3 months? I have an ongoing award for ESA and have just been given an ongoing (10 year) award for PiP....My conditions are not going to improve! 4 retests a year would be a total waste of money.

And to the OP...yes, unfortunately they can put you through the WCA after a year despite your award.

People going through cancer treatment? How about permanent disabling conditions like MS?Parkinson's? Post amputation?

And let's not forget that ESA claimants are tax payers too...

    Indeed.

Just think how many more £100's of millions the tax-payer would be paying to the outsourced companies for flawed assessments.

    HCP - "Didn't I see you 3 month's ago"

    Disabled person "Yes"

HCP "Has your arthritis / loss of vision / nerve damage / Parkinson's / cancer improved in the last 12 weeks?"

    Disabled person "No"

HCP "Really, I'm sure it has - because I've already exceeded my quota of favourable reports this week"

Taxpayer "I'll just get my wallet out. So there's £100's to ATOS / Maximus / etc for an incorrect assessment and I still have to fund the costs of the appeal to correct their decision".

On a more serious note, my local CAB regularly see people pushed into mental health crisis by flawed WCA assessments. The costs to individuals, families, NHS, society (and taxpayers) of this constant re-testing together with punitive DWP actions are hugely understated.

Silly, very silly comment Stop Watch. I suggest you take your witless disability bashing elsewhere, this forum is intended to help and advise others - not to insult them.

The point I was making was directed towards people who do not have a permanent illness or controlled illness. For example mental health, bad back or diabetic.

As for cost, it is about getting it right. The reason it is costing so much is because nobody likes having money taken away and will fight to keep it so use every trick and resource to do so.

Get Doctors in job centres there are far to many claiming to be sick of disabled when all they need is a kick up the back side.

This country needs some tough love.

You obviously have never had any issues with mental health either then! If you had then you wouldn't be critising!!! I think you should keep your critisium to yourself! or take it else where because it's certainly not wanted here!
