Bailiffs clamp car on finance

Urgent advice needed pls!! I had my car clamped by bailiffs 23/5/17 for a fine that wasn't even mine it was from previous veichle I sold & they rang up parking tickets etc on it as Dvla hadn't changed owner I got official letter from them but bailiffs wasn't interested I told them car was on finance & he couldn't take it he told me he knew it was on finance who it was with when it started & finished & he could & wud take it I had 2 hours to pay so I had to get my uncle to pay on his card as I was petrified need my car to work!! Since I've seen a similar post on here where someone got money refunded anyone help me with a way forward of doing this please

    Unethical or illegal, it worked and they got the money they came for.
  • No nothing more to it I argued with him about taking my car & he told me exactly when my finance was who with how much how long was left & said he was in his legal rights to take it & stupidly I believed him anybody know how I can make official complaint & get my money back?

    But you owed the money, why would they give it back? Admittedly they blagged you but case closed now.

    Edit- re read op, so you sold a car, failed to notify dvlc and the new owner got the ticket but the car was still in your name?

    The way I read it, though it's very poorly put, it was the new owner that failed to register the car and that the OP showed the bailiffs the 'official letter' assume that means the letter from the DVLA confirming they have received her part of the V5.

    You have paid but case is not closed you need to get the case set aside by the court who issued bailiffs and go to court and fight your case. Prove with your official letter that you are not responsible for the tickets. You have 2 weeks to get the case set aside and reheard I believe.

    Set aside needs to be applied for promptly, with valid grounds. If DVLA still haven't updated address then PCN's came to OP who failed to appeal them in time.


    Sounds like it's already been paid anyway...
