Do I have to accept a refund by cheque if I paid by card ?

    Eh? Section 34 says that the trader must refund the consumer back to the same payment method. If the consumer paid by debit card (from their bank) then the refund must be back to the debit card (bank account).

    So why did you say "Section 34 isn't really applicable in that its pretty unlikely that the business will have a debit card (nor you a card reader for that matter?)"? It was a nonsensical statement ... whether the trader has a debit card or the consumer a card reader is completely irrelevant.

    If you meant something else, please elaborate.

    Annual interest on £264 with any interest rate a standard garage will get will likely see them getting no more than about 4p. Youve just wasted a lot more than that using the complaints department and the member of staffs time that called you.

    For one off payments i think its much easier paying by cheque. To pay someone new online, i have to input their bank details. Potentially wait 3 days for it to process (never is). Have to authorise it using a silly little calculator and then have the payee stay on the list of payees for me to have to then delete it when i can be bothered to do so. A cheque, just write and send (another dig at the OP, it will cost them at least 56p for a stamp, that interest is looking pretty rubbish now).


    Thats a first for me, someone actually complaining about getting a cheque.


    I agree that paying a one off payment into a bank account is a pain , however refunding to a card is far easier then writing a cheque in my experience .

    It helps cash-flow. When my granddad bought a car for cash, the garage set up fake finance, to keep their business going.

    I once had a banker's draft which I no longer needed, so I got the bank to refund it ; but it still took several days to clear - a cheque which the bank was paying to itself.
