Major delays - advice sought!

    Also, while it's safe to presume that the tenants can be ejected one way or another, there's no guarantee that the title issue with the neighbours will be resolved, so you ought to have a Plan B for that. It's not clear from your description how big a deal it actually is and whether you can take a view on it (e.g. if the access has been used for a suitable number of years). Insurance would have been a potential solution if the neighbour hadn't already been contacted.

    I understand where you are coming from. We do feel, though, that if we pull out then we will be left wondering what might have been. It would be so much easier if there were other similar places within our budget now.

    There is no doubt that we wouldn't have gone near the place had we known that it was going to turn out like this. It has been soul-destroying.

    Well, put it this way - our solicitor won't let us proceed until it's resolved (rightly, I suppose) and she first mentioned it in January. An indemnity has been mentioned as well as a Deed of Easement. What could a Plan B involve exactly?

    I understand that the owner and his son used to have a property business/portfolio between them (before they fell out and stopped speaking) so I assume that it was never a problem between them at first.

    Finding a property to buy without these issues.

    In an ideal world, yes. However, to suit our budget we would now have to either lose the driveway (regrettably highly important for my work and lack of on street parking in this town), lose a lot of space (from an already relatively small property) be forced out of the area or, most likely any combination of those three.

    That's the reality you'll probably face anyway. Wouldn't it be better to start looking for somewhere else now rather than continuing to wait for this vendor whilst prices in the area increase even more?

    Well, possibly. That would suggest that this purchase will not go through, of course. Does that mean that this house simply cannot be sold? Is that even possible?

    Until the problems which are preventing a sale are sorted, there will be no sale!

    To what extent does the title discrepancy matter? Can the neighbours feasibly do something with the strip they own? Has "your" property acquired rights through x years of use without any objection being raised? If so can you get evidence of that by affidavits etc from the sellers? Can the property be accessed by another route? That sort of thing.

    ???? It's not a case of the house cannot be sold it's a case of your vendor not being motivated to sell. Even allowing for the vendor's spell in hospital he's dragged his feet for months. Feasibility the tenants could be in there for another 6 months easy.
