Moved next door neighbours old door leaning on our guttering - was I right?

Hi there

Our next door neighbour had leant an old door against the guttering of our house. Our boundary goes into their garden so our guttering and wall is on their side.

The very heavy door was leant up against the actual guttering. Debris and mess was starting to accumulate where the door was laid against our plastic guttering.

Anyway, I leant over their fence and moved it off of our guttering and leant it against their fence. I did not enter their property, I did it from my side.

You might ask why I didnt ask her to move it? Lets just say she is incapable of communicating in an adult way and to be frank I was scared of asking.

Do you think I have done anything wrong? Surely I am entitled to move it from my side if it has the possible result of damaging my property?

I would love to hear what other people think.

Thank you.

I think you've got a more fundamental problem if the bold bit is true. How can your boundary be in their garden? How can your wall be on their property? Are you sure you're correct or are you guessing based on the position of fences?

As for moving the door, I wouldn't anticipate a claim for criminal damage or trespass any time soon. It's an entirely reasonable and pragmatic thing to do in response to the situation.

    Hi Aylesbury Duck

Yeah, they are old council houses where at the back they had a flat roof portion that housed the shed and the downstairs loo - I am in a terrace of four and on all four a portion of the flat roof bit sits in the garden of next door and the fence is about a third of the way in.

It is like that all the way up - so her flat roof section goes into the next door neighbours and so on.

On the deeds it shows our boundary going around the flat roof bit and then coming back in for the fence.

Bizarre and to be quite frank a pain in the a*** as trying to stop them from drilling/painting our fascias is quite trying!

Thank you for your response - I sort of did it in a knee jerk way because it has been like that for over a month and I was hoping they would move it - but no.

I will now wait for the knock on the door for her to go nuts at me......

She also hung a metal bracket holding her clothes pegs off of our guttering, but I was lucky as the wind blow it across to our side so I was able to just take it off our guttering and hang it on her fence, where it has since stayed.

I mean, who would hang a metal bracket with weight attached to it onto someone elses pvc guttering?

Totally baffles me the lack of respect.

You should probably have said something, as doing stuff silently like that tends to look "passive-aggressive" and can cause trouble.

That's blind stupidity, not lack of respect.

    Thank you Strider

Yeah, I know, but she is so scary I chickened out.

I hate confrontation and was hoping her common decency would prevail.

To give you an idea of how she is, she confronted my partner in the street, calling him 'pathetic' because he hadn't taken her bin out at the same time as he put ours out!

She also called my partner a c*** because he wouldn't remove one of the trees in our garden so her daughter could have a better view - the tree was there when she moved in.

She is one scary and unhinged individual - you cannot communicate with her in a measured manner, which makes situations like this very tricky.

Doors(even heavy ones) up against walls have a habit of blowing over in the wind.
(I know I have a green house pane in bits to show for it and that door was horizontal

We have had those wind things round here in the last month thought quite a few places did must have fallen over at least one if not probably will next time there is a strong breeze.

Yeah - we are on the top of a hill and it gets really windy here - it could have potentially caused damage/cracking to our guttering.

Now, it will either fall over into their garden or damage their fence if it gets blown about.

I tried so hard to get on with her when she moved in but I think sometimes you just have to remove yourself from the grief!

Isnt it funny how something so small can turn into something so big....

Which could make you liable for the damage.

I have just noticed that one of the brackets on the guttering has come unclipped where the door was resting on the guttering.

So I was right in moving the door to prevent more damage being done to my guttering.

However, I cant rectify this until they have moved the door as I cant reach!

    Andymc....

If they choose to leave the door where it is that is up to them.

As they had already caused damage to my guttering I feel I was justified in moving it.
