Prescription Penalty charge notice

Hi,
Wasn't really sure which forum to put this on but will try here!
I've had a prescription penalty charge notice through with a fine for £100.80 as I 'ticked' the maternity exemption certificate.
I used to have one as I had a baby but she is 1 now and the pharmacy deliver my parcels so they just assumed it was still valid so ticked and signed it and delivered my prescription. In hindsight I should have challenged the pharmacy but it was 2 weeks after my daughters birthrday, I had arrived home to my prescription left on my door step and it didn't even cross my mind.
I'm now landed with a fine. I've written to them explaining that I didn't tick the box and I'm happy to pay but I'm not paying the fine as I didn't even see the prescription nor ask for the pharmacy to deliver it so as much as I didn't challenge it I don't think the fine is fair. I've told them to check that my signature isn't on the form as i didn't have sight of it. They've now written back basically saying tough. I've asked how I appeal against the appeal. I really can't afford £100

Their decision is correct, you allowed the pharmacy to sign on your behalf and you were aware that you had not paid. Responsibility for payment remains with you.
The next stage of appeal would be when they take you to court. This is likely to be a civil case but they also have the option to prosecute (these cases are rare). Either way, you won't win and you'll end up paying far more, at least double when the penalty and court costs are added.0 -
