Hmm it looks like it would be a case of my word vs his and yeah he may well have just not known, I didn't notice the light not appear. He was a really nice chap and from first impressions I didn't get the vibe he was trying to rip me off. I might just chalk it up as a lesson learnt. I did get a good deal on it (initial thoughts) so perhaps he sold low, knowing I'd spend to repair. I run cars into the ground so I probably wont ever sell it, unless its to the scrap man.0

Why not contact him and explain what you have found, don't blame or accuse just ask if he noticed anything when he had the car.
May offer to pay something towards the cost, may not. You won't be any worse off whatever.0 -

So the initial rant about him knowingly sell you it with kids in the car was just a rant? It did seem like an overreaction.0 -
if the airbag light does not come on it is a pass and maybe an advise down to the tester,i it comes on and stays on it is a fail0

Yep, no ABS light is not a fail:

I was under the impression the light had to come on and then go out, in order to pass the MOT.
I think you are confusing airbag and ABS light? Air bag light just has to be out; ABS light must come on and then go out. Anyway if you want to cheat you can get light flashers to do the job.0 -
I think I just underestimated how lax MOTs are.Why not contact him and explain what you have found, don't blame or accuse just ask if he noticed anything when he had the car.

I'd try this. Plus if he's only had it a month, it may still be under some warranty from wherever he got it from.
Google his phone number first, or get someone else phone and ask about "the car for sale" and see if he turns out to be a dealer. It's really unusual for a private seller to sell a car on after a month.0
