If you are booked on a package holiday the ABTA Code of conduct April 2015 rules 2l and 3l covers building noise and may be appropriate to your case. This would seem to cover both building works at the hotel and properties next door unless I am Mistaken.
  • We have a holiday booked at the Savoy Gardens Hotel. Yesterday we received a notification from Thomson's holidays that there is building work at a property nearby which may cause some disruption. It must be a fairly significant noise and disturbance for Thomson to contact guests. We are no mulling over whether to try and change our booking to an alternative hotel in Funchal.

We are going to the hotel on the 31st of July, tried phoning the change team and was on hold for nearly 2 hours and gave up. I emailed thomson and they are saying it is not affecting the hotel facilities and if I want to change my accomadtion I will have to cancel my holiday at a cost of £1100 . Thomson have got our money and basically are not interested in any concerns we have. I stayed there last year , it is a great hotel and island .

We received an E Mail informing us of the building works. We could not get through on the telephone to the holiday change team and ended up e Mail Thomson CEO . I got a response within 24 hours and they confirmed the noise from the diggers etc from the building next door was at an unacceptable level;. They were unable to give me alternative accommodation but offered a full refund which I have accepted. All the reports suggest the noise of diggers etc plus the dust makes staying at the Savoy Gardens not a good option. Good Luck

The building site next to the hotel is a development of apartments. The noise is still continuing and very disruptive,it was evident from 8 in the morning to 6 in the evening every day except Sunday. it certainly spoilt our holiday. Luckily we had only booked for a week and not a fortnight. We requested to move to another hotel but Thomson claimed there was no availability. We believe completion of the apartments is not due until mid 2018. If you have booked this hotel for a holiday we would strongly recommend you contact Thomson before departure requesting a full refund or an alternative hotel in Funchal. We understand that several customers who due to travel in July and booked on line did get a full refund whilst others who booked through one of their high street shops and were staying at the hotel as the same time of us were not offered anything.
