    Left a voicemail for solicitor yesterday haven't heard anything
    posted reply form declining 50/50 liabilty to procced with court actions.

    I couldnt accept 50/50 as I beleive as the 3rd party had advised I wasnt at fault

    I'd just like to add something regarding this post: In the small print of your insurance, you'll find that in the event of a claim, your insurer will expect you to do anything they reasonably ask in respect of them being able to recover costs. Not attending court at their request may have more financial implications for you in terms of renewal costs and even a legal bill, as they could then suggest that you aren't willing to comply with their requests in their attempts to recover financial losses on their part.
    Sounds like your insurer has paid you out on the claim, and this is now part of their process to recover their costs from the other party. I'd attend - you're not on trial, they are just calling you as a witness.

    Todays returned form advises I'll attend and you are correct my insurance did pay out at the tme of the accident and it is their attempt to recover costs of the claim

    thanks for your re assurance as you kindly advise I'm not on trial in effect called as a witness
