    I didnt 'see ' the other car at all until I exited mine' the other car has in effect caught the rear side driverr part and or bumper

    thats when 3rd party apolgisedvfor cutting into my lane unintentialy accpeted at fsult and offered to exchange details

    I honestly thought my car would have been repaired though from past experience if a car leaves a road insurers will often write the car off

    How do you know about lane changes ,if he was behind you ?You will be asked many trick questions ,like when did you first hear him or his car .

    Presumably you have some photographs of the damage.

    It is possible , on impact of the accident , you were forced to flee towards the right?This was possibly a sudden stress reactive response , by your automatic ancestral mind to save you from the attack from the rear.This caused your collision?The stress response is subconscious mind shutting down the command center in the brain , and going into automatic subconscious responses.

    Do some research on stress response of fight , flight and flee plus automatic mind .
    What you did with your car was a direct result of the attack from behind , the impact trigerred your automatic response.

    If you can find the right music for the judge's ears and ask for sympathy from the defendant and the judge , you may win.You have ask "why should you suffer ,because you did nothing wrong" .Now you have stated how it happened , I feel you have a good chance .

    Did you have other write offs experiences ?These types of statements give judges thoughts and thoughts become reality , the judges may think of you as a regular wrecker.So best not to say anything like this .

    Not a good idea to encourage someone to commit perjury on a public forum. Not for the OP and not for you. It's called soap on a rope and porridge.

    The only time I ever won with insurers is by playing dirty with the dirty , that was 30 years ago.
    I got hassled when I played fairly about 4 times.

    You must be very unlucky to have to make so many claims, let alone to lose each one. Something doesn't add up.

    I was high millage driver at higher risk of being hit by others , did not lose the 4 claims except they gave me hassle , by delaying 15 months to 2 years for settling .They were throwing silly offers and delaying settlement
