I wanted to check, even though I send it, I don't have to take them to court do I? I mean it doesn't set anything in motion that I couldn't just stop at any time?
No it doesn't mean you have to go to court - though why you wouldn't is beyond me.
For a single deposit claim you arrive, in your best frock / suit, have a nice chat with a district judge, who after 5 minutes gives you an order.
For the lack of deposit protection, the situation is similar, you pay a bit more upfront (£255), and have a nice chat for about 15-20 minutes.
It's done in the chambers, so no public gallery.0 -
Hmm so which of you is right?
I will avoid any of that at any costs (except maybe the full amount of the deposit).
I have no intention of going to court (the LL better not be reading this :P).
I would if I was absolutely forced to but things seem to have escalated very quickly.
Also do I have to give my new address on the letter before action?
I don't want to if I don't have to as I don't want someone who may hold some animosity against me having my address. Would just an email be ok and my bank details for return of the deposit?0 -

What do you mean 'which one is right' we have both said you do not have to go to court although if the letter doesn't work we both think you should go to court.0 -
why not just send them another email asking for your money back and saying that if they don't want to send it to you then that's ok because you don't want to take them to court and that this is the last they'll hear from you because you are tired of not getting an answer so please can I have my money as I am cross but not so cross that I'll actually do anything about it.
Then if you don't hear anything after that then just forget about it all.0 -

Choosing my words carefully - If you let people walk all over you, because you're afraid they may do something bad, you really wont enjoy your life.
If the LL was to 'respond' criminally it would be very foolish0 -

OP the poster was only trying to help. No need to be abrupt. Ok we get it you checked the sites!!!!!Happiness, Health and Wealth in that order please!:A0 -
You said...No you would have to start the court action
which implied I would inexhorably be led down the path of court action after sending the letter unless you missed a 'not' in there.
If I rang the agents and ask them if it is protected or not and if so where does this risk me losing my entitlement for compensation if it 'shows my cards' that I am on to them that they haven't protected since they could quickly protect it before I claimed or something?
because if it is protected I would prefer talk to the deposit scheme than court actions.
On the other hand even if it is protected and has been all this time (which I doubt) they still didn't tell me about it which I read on shelter means I am still liable for compensation right?0 -
