Hi guys sorry to create a new thread.

So my mother has been court by ANPR camera coming out of our local KFC which has one of these said cameras. She's decided to ignore these request for money thinking it would go away and now the case is brought before the county courts.

The situation is this, they say she has been parked there from 11.27 until 16.52 on the 11/12/2016.

The car park is literally 2 mins from her house which has a drive so why would she park there that long? its crazy.

I believe and know for a fact she has been going to the paper shop in the mornings for the paper and the camera has caught her on the way in but not on the way out and then when she has went back up later on to the shop again but hasn't been tagged going in but on the way out.

I also have a video which if I'm honest is not the clearest in terms of showing the date and i
know its not about what you know but what you can prove in court.

There is no way she is paying £320 when she hasn't committed the crime and the carpark is free to begin with.

I read some of the newbie section and cases but seem bit different to this one so i want to represent her and build a defense.

I was just wondering if i could have bit advice on what to do next.

and no "crime" has been committed , this is a civil matter, not a criminal matter

if its CEL, put CEL DEFENCE into the forum drop down search box and tick SHOW POSTS, then follow the same advice as given in dozxens of other threads this month (nothing older) - so june 2017 only

also read post #2 of the NEWBIES sticky thread, it explains all you need to know

post your defence draft on here for critique once completed

and acknowledge the MCOL online , leaving the defence box blank for now

the so called "offence" or better still , CONTRAVENTION , is known as double dipping , so read up about it

Thanks guys! yeh i got bit confused, it is CEL and I've edited title.

Concentrate on searching the forum on 'CEL defence'. There's a number of very current cases on the first 2 or 3 pages of the forum, as CEL have just issued a rash of county court claims, including your mother's.

The good news is that if you develop a robust defence they will cave and drop the case long before it ever gets to any courtroom. This has been their pattern for the past 18 months.

Have you (or actually your mother - everything in her name now) acknowledged service (AOS) of the court claim? That must be your first priority as it buys you a further 14 days to develop the defence. Check the advice in the NEWBIES FAQ sticky, post #2 on filling out the AOS, especially about putting nothing in the defence box at this stage.

No different from all the others.

The £320 will have been hugely inflated by their various dodgy practices, and is easily disputed. Have you not received any other correspondence in the meantime? Any LBAs? CEL often send an LBA for a lesser amount, then send the ticket on another round of debt collection in order to add another £100 or so, and then send another LBA. If you have all such correspondence, it's something they won't want a judge seeing.

!i!know its not about what you know but what you can prove in court.

You won't be proving anything on court so long as you defend this right, just like the other posters in the many many many other recent CEL court threads we have on this forum.

They will discontinue around the DQ stage.

yeh i don't think my mother kept everything they sent but i know its not far off with the dates etc.

ZZPS and Wright Hassall have been the main perps.

Thats good news i can use this as harassment etc i assume? speaking to my mother she started smoking again, been to the doctors for high blood pressure and put on tablets, no doubt this has been linked to this.

I want to hammer them if I'm honest.

Good luck with that! Have you looked into the cost and complexity in bringing a harassment case to court?

Just defend this and get rid of them.

You could try a counter-claim if they had no reasonable cause to get your data in the first place (e.g. if the car wasn't there for the time they said). Who is the defendant, you or Mum? The defence must be signed by the named defendant.

But TBH these are soooo easy to see off, you may as well just copy from another CEL defence thread and they will give up. No hearing, nothing scary, no need to stress out with a counter-claim unless you have good grounds under the DPA, for example. It's only CEL!
