One of the issues you might have is that the registered keeper may not be the legal owner nor could that be the person who was driving the car if there is multiple users. You might want to consider as a starting point to write to the registered keeper and put him/her on notice about the parking space and that he/she should notify all other drivers who use the car that the space should not be used. If the car continues to be used regardless of whether or not the registered keeper was the driver, you will hold the RK liable for trespass.
Although there's no legal obligation for the RK to disclose who was driving, any claim for trespass should be based around the RK being put on notice and if the RK failed to take steps to notify other users of the car, it is reasonable to hold the RK responsible for the trespass.0 -
Please do not do the following.....
Break match in the middle, but not completely into two parts.
Fold in half.
Remove dust cap from wheel.
Insert folded end of match into valve, until hissing noise heard.
Release grip on match [which should stay jammed in valve].

One trick with bollards/gates would be to lock the offending vehicle in, if you had a sign stating that "this land/space/gate is locked between 21:00hrs and 0:900hrs then that could get you round the POFA regulationns as long as you dont demand a release feeFrom the Plain Language Commission:

First of all I am not a monster.
Very often I've returned to my parking space (which is assigned to my property) and someone has parked in it. I have put up a notice to say "no unauthorised parking", but this has yielded little change. A neighbour told me about UK Parking Management and Enforcement Ltd ,who through their website are will to provide a service which, after signing up, will allow me (as the property owner) to contact them about any illegally parked car and they would issue a fine to the vehicle owner. The service they provide is called "Self Ticketing".
Can they legally do this? Does this expose me to any risk of court action? Is the company legitimate?

We own a 50 space car park and instructed a private parking company to run the site. It was a nightmare and is subject to an ITV programme on 6th July. I thought it would solve the problem just like you do but it created a far bigger problem! Let my experiences help you to not make the same mistake.0 -

Do the people who park blocking access to your bay, also block in other people ?
Is it the same vehicles, who might need only a polite note in the window, or random different people ? Do they leave at around the same time each day, so the police could attend to avoid a breach of the peace while you politely talk to them ?0 -

You raise an interesting point. I have taken a quick look at POFA and of course the references in there suggest that a creditor who wishes to claim 'unpaid parking charges' (defined as a contractual charge or for trespassing) must comply with POFA to hold the RK liable.
However, my posts were in reference to the common law position of trespass to land (where an individual or something belonging to the individual enters onto land unlawfully) rather than POFA specifically.
So, has POFA inadvertently overruled trespass to land claims in respect of vehicles? my view would be that POFA is in addition to the common law right so the OP would be wise to go down the more cost effective route i.e. common law trespass to land.0 -

Good luck (NOT) trying to fine anyone, we will simply ignore your fake invoices, we will also not tell you who was driving and if you dare to take us to court we will beat you as the Judges (other than the Supreme Court dolts) are wise to the parking management SCAM. There is nothing you can do - if we want to park in your spot you better put a big bollard up otherwise the public know there is NOTHING you can do to stop us parking where we want! It's a free country after all!! Unless you charge £25 maximum per day fake fines llike that hospital that offers effective parking management that Barry Beavis linked to on Facebook (Bristol?)If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.0
