Unfortunately.............. the old, old saying of.................WHERE THERE'S A WILL. ..............THERE'S A RELATIVE !! .....................is usually true. Even though your dear Father has passed on, your uncle is still obliged to pay this debt into your Father's estate, unless there is any mention within your Father's will stating the opposite, in clear wording. Until that is done, then I would suggest that any request made by your uncle concerning your Father's belongings, should be ignored or re-buffed and a firm reminder of the debt should be made. At times like these, families can be quite awkward and disrespectful. Good luck with your endeavours !!0

There is absolutely no doubt, this debt is part of your Father's estate and the paperwork involved should be given to the executor. If your Dad had given this money and not lent it, he would not have paperwork re the loan. Also, if it was lent within 7 years of his death it might attract Inheritance Tax, depending on the value of your Dad's estate. Very difficult for the executor to do their job if they are unaware of the debt. This needs sorting out now, before probate.

I'm not sure this needs sorting before probate. It just goes through probate as an amount owed to the estate. Just in the same way as an underpayment of state pension might (if you were really quick off the mark doing probate).0

Personally, I'd bring it up with him, write it off but give him nothing else and politely make it known he can sling his hook from now on.0
